Faulty KS360 bought from CPWH

My friend has a lg ks360 which has developed a fault(the speakers do not work). She bought it from the carphone warehouse about 5 months ago and would like it replaced or refunded. I've heard about the horrors of getting it repaired through them from stories online and my friends phone took a month to get repaired and she was told 3 times that it was back in store when it wasn't! It is a 30 minute drive away as well!
I notice that the CPWH has a 28 day returns policy and that they will try and make you get a repair on the handset but I also know of the sale and supply of goods act. If I go and ask for a replacement or a refund and quote the sale and supply of goods act then surely they will have to give it to me?

Please help me with this!

    The 28 days is the time that lapsed for you to examine and check that the phone worked. After 5 months usage, I doubt you can say you were not sold an item fit for the purpose.
    The phone will covered by a 12 month warranty by the manufacturer - you can take it to CPW, they can examine it and send it for repair or you can contact LG yourself (they might offer you a replacement if they cannot fix it).

    After doing a bit of googling it looks like lg is just as bad for customer service! oh dear!
    Do I not have the choice of getting a repair or replacement since I am within 6 months of purchasing the product?

    LG web site is pretty useless I think - go for cpw as a start and let them check the phone. If its not user caused damage, then you should be entitled to free repair - 3 failed attempts to repair, I think you can reasonably demand a replacement.

    If its contract, then try talking to service provider - they will though just offer to get it looked at first in one of their high street stores or sending somewhere - then possible repair job.

    By the sounds of the problem its probably just a loose connection at speaker end. If they can't repair it, they will just have to give you a replacement (as long as damage is not deemed to be user fault).
  • Sadly every manufacturer has the same policy and this is the policy they give to retailers. Which is 28 day then a repair. Given the high fault rate with phones( i work with them for a retailer and would say 30% of phones go faulty at a guess) no retailer can just refund as they would get stuck with the bill. Even places like asda that return most things would send it for repair. It sounds a simple fault so hopefully can be sorted
