there is no such thing as a zebra crossing unless it is on a public highway, so as you state, its just lines pained on the ground, that mean nothing
by stepping onto one in a carpark, the driver isnt under an obligation to give you right of way, however, you would think that as its a carpark, the driver would be going slow, and since you were walking in front of them, at least have avoided yourself - bit of undue care by the driver
I dont think the supermarket can be held liable in any way, because its up to you, as the pedestrian, to check that the road is clear - whether that be a proper zebra crossing or not

I would disagree with you here Flea. The highway code and the Road Traffic Act apply to places where the public have reasonable access. So that means that the rules of the road apply to a supermarket car park where the public have access.
So for instance if you drive the wrong way down a marked road in the supermarket and have an accident then you would be liable. Same with hitting a pedestrian on a Zebra Crossing whether it's on private or public land. It's reasonable to assume that the pedestrian has right of way.The man without a signature.0 -
A driver owes a duty of care to pedestrians, whether they be on a public highway or anywhere else. There would be no point in the pedestrian trying to make a claim unless the pedestrian was injured in the process. Also, it is not beyond the bounds of possibility that the pedestrian, by his or her actions, may have even contributed to the incident. In short, it is not always correct to assume that the vehicle driver is always at fault.0

I'm sure you are correct but why do supermarkets paint black and white stripes on the road? As this only causes confusion to both pedestrians, who think they are crossings and motorists who seldom seem to stop at them.0 -
A black and white striped piece of tarmac in a car park may not be a "zebra crossing", but that doesn't mean that you can run over anyone on one.
A car park is a "public place" and someone driving dangerously or carelessly could still be prosecuted. As a car park normally has a lot of pedestrians moving around, a driver should take account of this and drive accordingly. Running over someone on a black and white striped piece of tarmac, wouldn't meet that test.
If you have the registration number, I would report it to the police.0 -
My advice stop looking to blame someone and be more careful next time.
I get sick of the blame culture where everything has to be someone else fault. How on earth can this be the supermarkets fault?
Should they have staff to escort customers safely across the carpark to their cars?
Yes you may have been a bit shaken but I doubt you would have been hurt badly as the car was in a car park and would most likely been going slowly.
What exactly are you wanting to happen? Sue the supermarket or driver for money?
Yes in a ideal world it would have been nice for the driver to stop and say sorry to you but I doubt they even realised they hit you as you said they clipped you.
Maybe take some responsibility for your own actions and take more care when crossing the road. Don't assume you have been seen if a car isn't slowing down and try and do your best to get out of the path of a car.
I'm really sorry if you have however been very badly hurt by an idiot driver but from your post it just sounds like after compo from a minor incident which perhaps could have been avoided if you had taken more care.0 -

Because such markings are a recognised crossing point, however they are not a pelican, zebra, toucan, or whatever else, form of crossing. They are simply markings on the road.0 -
