Refund on a gift voucher?

Hi all, hoping someone can help me with a dilemma.

I bought a gift voucher for a beauty salon for my wife for Christmas, booked it over the phone with my credit card last week and it arrived a few days ago. In the pack is a voucher and a list of the treatments included as part of this package. It does not have any terms and conditions anywhere on the voucher.

Now, my wife has decided she does not want this gift, can I get a refund or do gift vouchers not have the same rights as products?

Thanks in advance for any replies, I'm hoping that I have not just blown £75 on a nothing more than a shiny piece of card.

    You can ask, but it is unlikely that you will get a refund.
    Gone ... or have I?

    gift vouchers are just like products, and like products you don't have any statutory right to return them just because you don't want them.

    You do if it is booked at a distance, i.e over the phone as in this case, then DSR apply.

    They were purchased by phone so if this is correct I should be entitled to a refund. I am still within my seven days so I will give them a call. I am expecting that my request will be initially met with some resistance however :(

    I have already told you in my post above,"a phone call is not enough"!

    From page 20 of the link in my post; -

    "What must my consumers do if they want to cancel?
    3.26 They must tell you in writing, or in another durable medium, if they want to cancel. This includes letter, fax or email. A phone call is not enough unless you say in your terms and conditions that you will accept cancellations by phone. "

  • I am going to call them first as they do not have an email address that I can find. And if I write to them it will probably be too late when it arrives.

    If you cannot find an e-mail address, they may not need to comply with DSR if they do not "normally" sell "from a distance", see page 7 from the link I supplied;-

    "If I generally do not sell by distance means do the DSRs apply to orders I sometimes get by email, phone or fax?
    2.14 If you normally do business with consumers face-to-face, the DSRs are unlikely to apply to an occasional order that you take in these ways."

    As Derricks initial quote says, the DSR only covers the vouchers in the form of plastic cards with magnetic strips (ie like credit cards). Dunno what you recieved, but most vouchers I have seen from salons tend not to fit this description.

    Just because you purchase something by phone doesn't necessarily mean that the DSRs apply. The DSRs only apply to retailers that "normally" conduct their business via a remote medium, ie, internet, mail order etc.
