Argos gave me two horrible bikes

I reserved two of this bike:

And they gave me a vile shocking pink monstrosity that i would never have knowingly paid for with bees (?) all over it (seriously it shouted 'chav') with tassels off the handlebars.

I want a refund not in vouchers because i will now have to buy two more bikes from a different shop.

However it does say at the bottom about 'cosmetic differences'

Can they get away with not refunding me?

The packaging was already opened suggesting I'm not the only one that thought they were awful!

    If you got a substitute go back and explain.

    How could you know what it looked like before you opened the box? There is the 30 day returns guarantee anyway. So should not be a problem.
    I always wanted to be a procrastinator, never got round to it...

    The website does state:

    You may receive a substitute of the same specification, but cosmetically different.

    Also it appears that some people love the pink version!

    Nonetheless I would agree with icefall, unless it is exempt from the moneyback guarantee you should not have a problem with returning it.

    Even though the website does say items might differ cosmetically, going from the bike pictured on the website to a pink bike with bees on is a huge change and I would expect them to refund in this case.

    You say you reserved it, so I assume you went and picked the item up from the store? You would have had a much stronger case for getting your money back if you had had the items delivered. But I would still expect you to be able to get a refund if you picked up from the store seeing as the picture is so much different to the item you received. Take back to Argos ASAP.

    I am going to ring them this morning, I was supposed to be child free today and take them back but the relative who was meant to have them has pulled out because all the roads are covered in sheet ice the entire way from hers to mine (over 5 miles) and the dual carriageway is closed, lengthening the way by miles.

    I will let you know what they say when i ring them I am very unhappy as now i have missed all the christmas delivery deadlines and am probably going to have to get OH to drive miles to pick some up :(

    How did you reserve them? Was it in store or out of store? If it was out of store the Distance Selling Regs should apply and you can return within the time limit for full refund.

    I reserved them from the website and collected them from the Castlepoint store. As it is i may have to use the hideous ones as it's going to be epic trying to get 2 more

    Go and buy your child a decent bike.

    It will cost you less in the long run as thy hold their value very well.
  • Also you get your bike built by a trained professional. The bike wont last very long without the correct torque on all of the nuts and bolts and the correct brakes set-up.
    Back by no demand whatsoever.

    By the way, I remember seeing cheap Argos build-it-yourself bikes (other retailers also sell these bikes) on Watchdog or a similar program, they were claimed to be very poor quality bikes with some safety issues and hard to put together properly.
  • Argos have a 30 day no quibble guarantee anyway so I can't see why they would not refund by the method that you paid.
