    How long ago were all the bank charges? I know your now a money angel, so obviously not recently. Even if you go away for a year, you can still go back 6 years, some charges may drop off, but you will still be able to claim for a chuck?

    This is what I put for my claim.

    I have a contract with the defendant bank
    which is conducted on their standard terms
    and conditions. I am claiming the return of
    money taken by the defendant in the way of
    charges over the last 6 years plus the
    interest they have levied on those charges.
    The bank's charges are a disproportionate
    penalty and therefore unenforceable as they
    are contrary to common law. Further, as a
    disproportionate penalty they are invalid
    under the Unfair (Contracts) Terms Act 1977
    s.4 and under the Unfair Terms in Consumer
    Contracts Regulations 1999. Para.8 and sch.2
    (1)(e). In the event that the charges are
    not a penalty then they are unreasonable
    within the meaning of the Supply of Goods
    and Services Act 1982 s.15. I am owed £XXX
    for account number XXXXXXX. The claimant
    claims interest under section 69 of the
    County Courts Act 1984 at the rate of 8% a
    year from 19th December 2001 to 8th June
    2006 of £XXX and also interest at the
    same rate up to the date of judgment or
    earlier payment at a daily rate of 0.17%.

    There isn't much room for change in this as it's at the maximum number of lines. Just remember to change your account number, amount your claiming, interest your claiming and the dates your claiming between.

    In answer to your question about interest it's 0.17% per day as above!

    To be honest I had kind of decided yesterday that I wouldnt pursue the claim, but now I have changed my mind again!!

    Mountainofdebt - thanks for your PM - shall reply in a minute (SS - its not another admirer, so dont worry ;) - I only have eyes for you!!). I am just paranoid that they will make an example of me, as that would be just my luck!!

    Whilst I am writing about MCOL - remember the ebay scammer that ripped me off from last year who I tried to claim back using this site, but it never come of anything - well now the defendant has a CCJ against his name. :rotfl: :rotfl: I know its mean, but serves him right!! :mad: :mad: I not only lost the original £160, but also the further £80 I had to pay to do the claim.!! However, the police are investigating it & know where he is etc (i wasnt the only person he conned) and hopefully he will be taken to court....

    Surely you can send the ballifs in or something to seize goods to the value? :confused:
