Sky mis-sale of goods

I wonder if anyone can tell me if sky are in breach of sale of goods or trade descriptions act with the following

Have been a sky customer for 20 years and still had original sky box and dish
3.0.09 rang sky to see about gettting sky+, initially told it would be £400 unless I took out multiroom which i didnt want.
5.9.09 rang back to speak to cancellations dept and told woman what price I had been given, she was horrified and said no the boxes are only £150. I explained I had been a customer for 20 years+ and didnt see why I should have to pay for a sky+ box. She said she would have a word with her supervisor. Came back and said could get sky+ box installed for £29 as I was long serving customer. I had to agree to a further 12 month contract. Please note that at this point I was NOT informed that this would be an old reconditioned box and that it would not provide all the new services.

later in September, sky box installled and working, again no mention from installer that it wasnt a new one.

20.12.09 went to my daughters house and saw her SKY HD box and they showed me sky anytime. It looked great so I went home and tried to get it on my box. I couldnt find it anywhere on mine. Looked code number up and found out mine is a 2002 box which cant get sky active.

21.12.09 rang sky up and was told it was a reconditioined box and someone would ring me back.

22.12.09 received phone call from sky customer services. To cut a long story short, I put the point to him that a) I was never informed that I was forking out £29 for an 8 year old reconditioned box that could not get all the current services and if I had been told that I wouldnt have agreed and b) was he going to refund the £29 or change the box. c) would he release me from the 12 month contract.

His answer to all three was no, as far as he was concerned it is pot luck what box the driver has on the van as to how old it is and sky active is a free service so it doesnt count if i cant get it. Any they wouldnt recind the contract.

So my response to him was 'so you are saying its tough then and that is the level of your customer services.' To which his reply was 'tough is a harsh word but basically yes thats it'.

So do I have any recourse to further complaint, I feel I have been sold goods which were not as described and in my opinion not fit for purpose.

    Email the CEO jeremy.darroch@bskyb.com.

    Just be polite and explain what has happened and you will more than likely get a reply from the Customer Escalations Department whom he will pass it onto.

    The installers carry a van stock but this is rotated,when you get your daily work (or weekly) for deep field engineers,you get issued the boxes ect that you need,the next day,any stuff you did'nt use (bar van stock) is returned to the stores & new issued.
    (or it was when I did it)

    I would also suggest you paid £29 for the installation, the box itself was free. So they did not sell it to you, they gave it to you. Sky+ boxes are kr@p, give it a week it will break down anyway so you will be getting another box very soon!!

    We have a Sky+HD box and at the mo seems more reliable..... Famous last words!!! :rolleyes:

    Have sent Mr Darroch an email asking what he is going to do about it, so will see what happens now.
