Harveys "GUARANTEED CHRISTMAS DELIVERY"

Why not shovel some snow in from the outside, mould it into a sofa shape, then leave all of your doors and windows open until it freezes solid.
Hey presto! Not only do you then have somewhere to sit, but what could be more festive than snow chairs at christmas? It would also have the added bonus of keeping your lager chilled while you watch the christmas repeats on the telly.
One word of warning though - I would not recommend using any of the special yellow snow for your christmas sofa, even if it does match your decor. All matter is merely energy condensed to a slow vibration, we are all one consciousness experiencing itself subjectively, there is no such thing as death, life is only a dream, and we are the imagination of ourselves.0 -
haha - great money saving idea : )
only problem - no snow in liverpool - bit of hail and rain and ofcourse some lightening this morning but no snow0 -
just called again for an update and the young lad told me that he didnt know where my consignment was, they werent too sure if it had been delivered or not?
i asked to speak to someone senior - in which he said he will pass my details on.
i asked about a loan unit for christmas - he said go to the store, i advised it was closed and he said go on thursday (christmas eve) when it doesnt open until boxing day.
im really hacked off to be honest.
depressing walking in to your home without any furniture!0 -
Well we have finally spoken to the complaints department about this, we can't cancel our order, Harveys do not offer compensation or refunds and our sofas are sat in Basingstoke with 5000 other orders that are supposidly going to be delivered on the 6th Jan, what a load of !!!!!!!!! I am going to the store on Boxing day to make a scene if nothing else and to try to put some other poor souls off of buying from the Cowboys!0

spoke with harveys again this morning and they have assured me i am first drop off tomorrow morning on vehicle id ME so fingers crossed but im not counting chickens!
alternatively ill be with blueboy on boxing day!
My bird has been on the phone to trading standards this morning and they have told us that we would be entitled to compensation etc if it isnt delivered pre-christmas as stated in the special instructions on invoice it would be a breach of contract because it was due on the 9th then 14th etc.. nothing to do with bad weather!0 -
If it were me I would write a letter informing Harveys that;-
1) They are in breach of the contracted and Guaranteed delivery date.
2) You accept there proposed alternative delivery date of the 23rd December, time is now of the essence.
3) Any further delay is unacceptable and as such if they fail to deliver on the revised date that they should immediately provide a full refund.
4) Also express disappointment about their poor customer service.
When they write back rejecting your letter pointing out there T&C’s respond with a letter along the lines, and
when they don’t deliver on time (which they are unlikely to due to the fact that they are useless) write along the lines:-
1) They offered a Guaranteed delivery prior to Christmas which they have failed to meet. It is clear that such a Guarantee takes precedence over any other clauses in their T&C’s and as such you consider that they are in Breach.
2) Order is now cancelled
3) Full refund from Harveys within 7 days
4) Delivery no longer accepted
When no refund after 7 days
1) Notice before action letter (i.e. they are in Breach if no refund after 7 further days you will be taking then to Small Claims Court
When they ignore that , take them to the Small Claims Court. (its easy to do)
You have a very good case from what you have said here – in my view.
Good luck - you are better off going to a back street manufacturer who tend to be better value and quicker than these large and to be honest incompetent chains anyway!0 -

All good stuff but the OP wants the furniture, not a refund.0 -
You ain't going to get the furniture but if you really want it the hang on. As for compensation then it appears that Harveys are indeed in breach of contract ( t&c's noted) and you would be entitled to claim reasonable damages for this. A loan sofa etc is not reasonable but £x per day is! Alternativly a refund plus damages from breach is possible. Stay away from the word goodwill or compensation as they don't count.
But you would have a good case for buying furniture from say john lewis of a similar type and claiming for the difference from harveys. It would be a battle and maybe a court case but still a possibility. I had the same issue about 3 years ago, settled after 4 days of calm polite but firm conversations with regional managers. These are my thoughts and no one else's, so like any public forum advice - check it out before entering into contracts or spending your hard earned cash!
I don't know everything, however I do try to point people in the right direction but at the end of the day you can only ever help yourself!0 -

OP would lose - weather is force majeure.
However they didn't arrange a pre-xmas delivery date, which suggests they never were planning a pre-xmas delivery.0 -
Which is exactly the way I was coming from.
Quite reasonable is they had called and arranged for a delivery on the 20th, then called and cancelled on that day stating bad weather. But they haven't, which leads me to think that the sofas may not even be with Harveys yet.
The OP needs to make his/her mind up what they want, wait for the furniture or get a refund and go elsewhere. Personally I hate Harveys, only because once the salesman/woman has your money the customer care is rubbish (a polite word).
But people still shop there so they must be doing something right. These are my thoughts and no one else's, so like any public forum advice - check it out before entering into contracts or spending your hard earned cash!
