The DVLA have told me that they will issue a V5 in the new persons name, so there is nothing I can do. The DVLA do not "get involved in issues or disputes of ownership"...
This all sounds very strange.... if i was to go to someones house and "fish" their keys from through the letter box and take their car then I can claim ownership and they won't do anything?!?!?!0 -

I'm not so sure. My girlfriend is currently doing a Legal Course (ILEX) and one of the examples in the course notes is very similar to this. I cant remember the case exactly but it did turn out to be theft once the item in question was sold on.

For it to be theft there has to be an aspect of dishonesty to it. There doesnt seem to be this here hence why probably its not being treated as theft.
OP could take civil action against the garage but they probably would just issue the OP a bill for services to the value of the claim.0 -
alarm bells for me would have rung when it went so long not being able to find an engine
tigra is just a corsa in frock so i would expect to be able to fund a decent engine in a matter of days0 -

The OP gave their car to the garage so they could repair it yet instead they sold it and presumably pocketed the cash - I would say this is just a tad dishonest. Also it appears the car was "scrapped" almost immediately in July despite the garage indicating they still had the car in September and were still looking for an engine - apparently (from what the scrap yard said) this is an outright lie!0 -
All sounds very strange but if this is indeed the whole story, I'd be:
1) Phoning and then writing to the garage and telling them in no uncertain terms that they owe me a car. That I'd left it with them to be fixed, at no point agreed to it being scrapped, and I want a car back. Then threaten legal action if they refuse.
2) Naming and shaming the garage online and in the local press.0 -

yep, My tigra engine was replaced last year, managed to find one the same day for £250 :T2010 resolutions1- get my 5yo DD dry daytime, with enuresis help dry since 12th Jan so far!
2-Lose 3 stone inc giving birth :j baby born 11/02/10! lost 2 stone, 1 more to go!
3- more moneysaving! sealed pot number 851SAHM getting organised, dont wanna go back to work after mat leave
