Late rent payment

Hi everyone.
Im looking for a little advice. Ive never missed a rent payment, but my rent is due out on the 28th of December butt Im not able to pay it until the 20th of January. If I didnt pay until this date I wouldnt get kicked out would I? My rent goes through an estate agent and then to the landlord. Im panicing about the late payment, I dont want to phone the estate agent incase they say I have to pay, and then Im !!!!!!ed. Any advice?

  • Sticking your head in the sand and saying nothing will not help.
    Phone the agent in the morning and explain the problem, say that the payment will be made on 20th Jan, then make sure you do just that.

    if you pay on 20th are you able to pay next month on the 28th when due? Just trying to work out how big a problem it is.

    Well,,, grounds for requesting a possession order to get you out under section 8 of the "Housing Act 1988" include these two...
    Ground 10 - This ground covers arrears of rent being in arrears less than the times specified in mandatory
    ground 8. This ground also, with the consent of the court, allows rent recover by distress.
    Ground 11 - This ground covers persistent delays in rent payment. However, being a discretionary ground the court will take into account factors outside the tenant's control, for example, delays in housing benefit payments
    - but these are discretionary grounds - in other words the judge can decide if he thinks you really deserve kicking out or if you should be given another chance... (cf. Ground 8, behind 2 months, the court has to grant possession to the Landlord if you are 2-months behind when the papers are filed & when it gets to court...).

    So, talk to the agent, maybe write a calm & sober letter to Landlord (you do have his address?? With no address rent is not due to to paid...) and explain your position, grovel a bit, and hope it doesn;t get to court.,..

    Thats a very cynical thing to say when you dont know me. Im a student nurse who recieves a monthly bursary which covers the rent and it was due on friday just gone and never went in. I phoned them and they advised me that they cant make the payment until January the 20th with my other payment.
    Sometimes people do have genuine reasons behind their predicament.

    In my experience it is very unlikely any judge would grant possession in these circumstances, but you should endeavour to keep Landlord & agent sympathetic..

    Your first step here is to make contact with the Letting Agent, and let them inform the Landlord.

    If your open about this then i cant see any issues. A good gesture could be to pay something, then next month you dont owe as much.

    The good news though, I think it takes 2 months of non-payment of rent before they can evict you.

    Just explain your situation to the EA hopefully they will understand but in January you will have to make sure that both payments are made on time.

    do you have a contingency plan?
  • I'd rather go into overdraft or get a loan from the bank than to not pay my rent on time. If this is an option I'd ask you to consider this in the strongest possible terms. You might need the landlord on-side some time, like when repairs are necessary, and you wouldn't want your relationship damaged then
