Can idemand a new phone if faults keep happening?

My son has a contract phone with vodaphone and the speaker has gone twice now in 6 months, he got the phone back last week and now it has another fault. They tell him all they can do is send it away to be fixed, is this correct?as if it was something i'd just purchased from a shop without a contract i'd be demanding my money back. Does anybody have any advice on this?.....thanks heidi
