    Make a point by point rebuttal of the hearsay evidence they are quoting and as has been advised above, take advice pronto.

    I have been speaking to people all day about this, noone is interested in these types of cases unless it is actually libel, much easier to prove.

    I agree this is a broad brush of accusations but I think in their eyes they will decide that there is no smoke without fire on a balance of probabilities.

    They are asking me to the Disciplinary on BOTH the drug use and my attitude and threatening behaviour towards the manager.

    I mistakenly put that the statement said my eyes looked 'funny' it actually said "his eyes did not look right"

    I think that they have really tried their best to stitch me up here and i don't hold out much hope for the disciplinary. As someone said, if they wanted me back they would have been a lot more speedy than this.

    I may stand a chance at an unfair dismissal tribunal, but wouldn't the three statements saying that I was "aggressive" in my manner etc throw me out on a balance of probability, would that be reason enough for them to dismiss me with my statement and that of two others reporting the contrary?

    Honestly, I was reading the statements and by the end of it, even I was convinced I was a no-good drug addict.

    If that is all they have, then they are screwing themselves.

    BUT to deal with this you need to have a cool head and a lot of focus.

    You need to focus on the actual charges. Never mind the statements for the moment, they are little more than a wind up. You need to focus on the narrow charges and then look in the evidence for the material that backs up the charges. Then you need to show that it does not go anywhere near proving the allegations. And then you need to be able to dismiss the rest as not relevant.

    At best what they have is circumstantial - most of it is probably not that good.

    AGAIN BUT do watch out for the accusation being changed on you mid flight.

    I really feel for you, unbelievable isnt it.
    You contacted you gp regarding being tests which proves your innocent in my books.
    As for being aggressive or abusive so would i be if i`d been accused of that!!!
    I hope you get things sorted eventually and if they do dismiss you i`d take it further.

    Have you put the official complaint about the manager's outrageous behaviour on the night out in writing and submitted it to HR yet?

    They have absolutely nothing so far. The girl who said you'd offered her drugs, has gone on to say that someone told her you were joking. The last big of her statement is irrelevant, as that's based on the manager's outrageous treatment of you.

    The rest are all garbage too, and nothing worthy of using.

    Have you spoken to someone at CAB yet? or ACAS?

    No, I am not perfect, but yes I do judge people on their use of basic English language. If you didn't know the above, then learn it! (If English is your second language, then you are forgiven!)

    No, I haven't put in the official complaint about the manager yet, I have too much to deal with on my own side of things. I also have absolutely no idea how to raise a grievance even if I wasn't busy.

    It may be that they have nothing substantial... but if you throw it in a blender and mix it all up, it looks absolutely awful.

    Sales manager has stated that he 'possibly' made the public statement about me being a "smack head"

    I've spoken to my mate about his statement. He said he had to get them to change it because they were trying to fit me up with one of the sentences.

    Also the 2 statements supporting me are about 50 words in length, whereas the ones that don't support me are in excess of 250

    I called ACAS first, and they said that they couldn't really do anything and that they think its quite a strange situation. They then referred me to someone in Legal aid, and they have agreed to support me.

    As you're at home, I think you need to put it in writing, and send it recorded delivery to the HR department. (unless anyone else on here knows a better way????)

    Detail his unacceptable behaviour and what happened, and write down a list of witnesses that were there at the time who can verify your story. I would perhaps then say how he SHOULD have dealt with it if he felt you had a drugs problem (which you don't).

    Go on to state that you expect a full investigation to be carried out into this unacceptable verbal abuse from <name of manager>, and look forward to their response.

    You MUST do this ASAP. The case they have on you is based on utter garbage. Your own complaint against this manager has substance, and needs to be taken seriously. If they don't take it seriously, you can use it in your case for unfair dismissal. Don't forget recorded delivery...
