..me as a landlord to lose my house sale, spend thousands on removing a tenant who clearly wants to abuse the system just to get a council house?! You think it is fair for taxpayers money to be spent on housing people who clearly have been offered options, the tenant is in full time employement...i suggest you re-read the whole thread.0 -

Landlords have to act within the law - you want to bully your tenant out..... not nice..... not at all nice....... AND illegal
Harrassment of A tenant accrues a prison sentence if you are interested.
If you had known what you were doing,
you would have either not let,
or given her notice to quit much much earlier,
or agreed to complete much much later - its no good blaming others for your ignorance...0 -
I have not been harassing the tenant, i have offered help and assistance above and beyond my legal requirements. Furthermore I wonder if I would be breaking the law if i put a local advert in the property paper warning local landlords of this tenant.
Depends what you are seeing as help. You might be offering her a bigger house but it might be in a crap part of town, it might be away from her friends or her family or her childs school. So for this reason she probably wants to see it out.0 -

You say that you have a solicitor who has served the S21 - get him to talk you through the Protection from Eviction Act 1977. If you're cheesed off about a potentially lost house sale, think how much more you'll have to worry about when you have criminal proceedings brought against you0 -

Not everyone in a council house is expecting taxpayers money to pay their rent, my husband is in full time employment too. Only his take home pay almost equals that of rent in this area. My mother probably thought the same as you but if you were happy enough to take the rent then you should accept the rules that go with that. If you wanted to sell you should have given her sufficient notice to enable you to do so.
You say you have a solicitor - I'd be looking for a new one if he knew you had sold the house with a tenant in it that had no right to leave yet (you have not even been to court and assumed she would leave just like that - even with children). If the council think she has a good chance of getting housed they will be advising her on the right things to do so her application is not put in jeapordy, they did us.

Sorry but you seem to only have your self to blame.
You have come on this forum asking for help, then have spent your time slating the 'professional' and respected members of this board.
If you don't want the 'correct' advice, then don't ask for it. Go on your merry way, chuck the tenant out, move her stuff, move in with her and advertise the fact in the papers. See where it gets you.0
