My bank threatening court over their mistake-please help!

  • The bank is under a duty to act fairly and reasonably and so if you contact them, they may be able to come an arrangement to pay in installments, if you can't afford to pay it all back in one whack. However, if you can afford to do so, it is reasonable for them ask for it back in one go.

If they did take you to court, the judgement wouldn't be for more than you can afford anyway, so contact them and come to an arrangement. As others have said, if the money isn't yours, you do have to pay it back at some point.

I think the point they were making was that if you really, desperately wanted to resolve something like this because it was causing so much stress, then somehow you would find a few moments to make a 30 second phone call. The fact is the OP has had more than reasonable time and opportunity to have sorted this out by now & has chosen to drag her heels over it. I am sure even a teacher can find some spare time in her hectic lifestyle to make just one simple phone call if she was that desperate to return the money. She's had over a year to sort this out. How long does a teacher need !!!!!!?

    unnecessarily harsh

Being on a forum while students are doing a task is one thing, being on the phone discussing your financial situation with your bank in a class of 30 eavesdropping students is totally another. Would you wish to discuss your financial details in front of 30 14/15 year olds? I doubt it. If I need to get in touch with my husband during a teaching day, the ONLY way is by email....as at some point during the day he'll be online.

  • Hello! I'm new to this forum and need advice on being denied credit. I am indispute with a bank and a utility company over their misleading me in the first case and their refusing offers of payment in the second.
Because of this they have both put me on the Credit Risk list to stop me getting credit! Experian tell me I can send in a notification that this is wrong but it will not help my credit listing.
How can they do this without a court decision because I am fighting them for my rights not defaulting on debts?

You're obviously not a teacher :rotfl: I'm lucky if I get 15 mins to eat a sarnie and make a cuppa before the madness starts again. Also finding anywhere to make a private phonecall is sooooo difficult.

Writing a letter would have been the most sensible option if no time was available for calls during the day.
The op has had a month to do so.
Being a teacher I guess she must be capable of doing so.
