Exchange before xmas but owners not moving out till new year?

    Saxo-S don't be blackmailed, don't be nice because its xmas and sack your solicitor!!

    when the lender transfer the money the property must be empty, the keys should be yours within the hour. Any solicitor not ensuring his client gets this is not acting in his clients interests.

    Don't phone them anymore write a letter saying that when you complete you expect the house to be empty and will not be completing unless. Tell them the price you have agreed is for completion in Dec 09 and that if completion is not going to be until Jan 10 then the price you are offering will be reduced by £1500 to cover the unexpected stamp duty.

    Do not answer the phone to them, let them leave messages and answer after you have thought about your response.

    If all else fails walk away and tell your solicitor to whistle for his bill, he made this situation he can pay for it.
  • I'm in a very similar situation - vendor wouldn't move out before xmas even though my offer was accepted five weeks ago (he has been in the house 27 years right enough) and I wasn't going to pay stamp duty because of it - he wouldn't reduce the price by 1500 quid so we came to an arrangement where he invoked "right to occupy" through the sol. Basically he gets 4 weeks after 23rd Dec to get his stuff together and get out. It also means the sol doesn't draw the mortgage until 23rd Jan (the 4 week period) so I don't pay a months mortgage for nothing.
    It's all above board and means I don't lose any money (stamp duty or a month's mortgage payment) - To be honest I'd rather wait another 4 weeks than pay 1500 quid!
