Exchange before xmas but owners not moving out till new year?

  • I am amazed your solicitor is even asking you to do this, he should be telling them to go jump as soon as they suggested it without burdeoning you.

    You are right to not let them live in the property after completion, don't allow this under any circumstances. I would also inspect the property on exchange and prior to completion to ensure they haven't caused any damage etc.

    If they dont have anywhere to go, why dont they just put the furniture into one of those storage facilities and live in a travel lodge for a week, or if they have family make a holiday of it.

    I have to agree with OP, i wouldnt buy a house off anyone and let them stay on rent free just because they want too. TBH cant believe your solicitor would even agree to suggesting it to you.

    Exactly, as was pointed out in another thread their insurance does not cover them and yours wont if you are not living there. What if there is a fire? No-ones insurance will pay out.

    Thank you! Its a bit scary though. I don't want them to live in the house once i've bought it yes yes, it was bad enough asking for some money for them to live there but if they aren't giving anything at all AND using the heating, water etc in that time also then they can rethink that quite honestly.

    I don't know why they can't move, its the people their buying from who are causing the trouble as far as i'm aware, they are moving into an empty property but the people who own it don't live close and they can't be arsed to take the stuff out of it this weekend I do believe.... so i'm suffering for that now.

    Yes.... negociation. I'm not a negotiator though, i'm nice and friendly and quiet....
    This should all be smooth though... There were no issues till thismorning *sigh*
  • I work for an insurance company so i know how picky insurance is. I think they would insure me if i owned it but was not living in it, as long as i have financial interest in the property then that is adequate I think? Well either way this is getting more complicated than i want it to be.

    Its sorted *fingers crossed* Solicitor called back, said all the solicitors are open on 31st, can exchange and complete then which means i'm not paying stamp duty and they won't at any point be living in a house legally owned by me. Stressssssssageeeeeee

    They are mucking you around, you do not have to put up with it. I would walk away. However two suggestions:-
    Tell them they either complete before the end of the year or the price is reduced by £1500.
    Whilst I am strongly opposed to letting them stay in the property, you could suggest that your solicitors retain £50,000 which they agree to forfeit if they do not leave the property on the agreed date and in good condition.
    just seen your earlier post(no 19), would suggest you physically inspect property before completion to check they have actually moved out.
  • Ooooooo there are so many complications that were not even thought about. I will tell them i'll just pay stamp duty if not. Its fine :) I'm happy now. let the weekend begin!! x
