HFC - Long term case

Hello,
I pop on these threads every now and again fro help and advice as you always know the right steps. Here's the latest obstical!
HFC - we took out a loan then a top up loan later that year. This was about 2006 so we requested the information through all the right channels but they had lost the paperwork and only could give us computer records... anyway eventually claimed the PPI back but they did not respond in the time scale so we contacted the Financial people (sorry cant remember the name!). They took the case on but because of the back log there was a waiting time. This was back in May since then HFC have offered us a goodwill against 1 of the loans of £100 and ignored the other loan completely (ironically the biggest loan). We declined this and left it to have an adjudicator look into it. The case was due to be assigned an adjudicator by the 4th December but this did not happen due to issues they are having with HFC. I suspect this relates to the lost information. What happens from here? I thought all companies are meant to keep paperwork for 6-8 years so surely if they've lost it, its a breach of the data protection act. More worryingly it has all my OH's personal details including addresses and bank details on it?!:mad:
Really i just wondered where we stand on our claim and what we can do about the lack of care for our information.

So sorry to hear of the runaround your going through.
That is very typical of them, especially in regards of the biggest amount loan/ppi.
Have you thought about ringing the ICO for some advice on this, just to see what they suggest?

I would see what the ICO says about this when you contact them in the new year, hopefully there are ways around this so a reclaim can still be made.;)
They may suggest a few things to you at the time.

The financial Ombusdman are still looking into it. They are sending me a letter as they want a copy of all the paperwork i have. This isnt a lot as the HFC could only provide me with a copy of the computer system print out as they have lost all the original paperwork. So not really sure where this will go tbh.
Also contacted the ICO and they are now sending me a form to complete as they believe it is a breech of the data protection act where they have lost the information. If they uphold it is a breech of the act is there anything we can do against HFC? I know this isnt the place for this question but it is sort of relevant to my original PPI claim

Just another update, They send a letter which we received on Saturday to say they had all the paperwork they now needed and we're just waiting to be assigned an adjudicator. Lets hope they get a move on considering we should have been assigned on by the 3rd December at the latest... grr.... hope we get some news (good news
) soon

Just an update (Another!). Just rang for another update to be told it was passed to the adjudicator team last week now just waiting for someone to pick it up. Any idea how long this can take? We're fast running out of time to sort this out before the baby arrives in June, never mind
Hopefully it will be sorted for both parts of the loan we took out with them as i dont want to go through this all again for just 1 of the loans as the other was a top up!0 -

Now its with an adjudicator, this can vary, they will write to the other party to request for further information, and they are normally given a timescale on when to provide it, sometimes the other party requests for longer time.
So basically - although it can vary, if all straight forward say approx 6 weeks, if the other party does not agree, then normally the case is moved on to either another adjudicator, or the ombudman himself, who generally does go by the adjudicators decision, and the other party MUST oblige by the ombudsman's final decision.
