  • OP, regardless of any of the other facts, if the following are true:

    1) You had a credit card under the age of 18
    and
    2) You lied about your DOB

    Then I would think you may possible have a case against the bank that issued the card (I'm no legal beagle, but it sounds probable).

    HOWEVER, I would also think they would then have a legal case against you for fraud, for lying about your DOB.

    It's not worth pursuing imho - it'll bite you back.

    Pay up and stop trying to worm out of not paying for something you benefit on!
    Also if you bring this to light, they will load a CIFAS marker against you to say you lied at an application stage making you get any further credit extremely difficult.

    Interesting thread. I obtained a credit card at the age of 16 by lying about my age. I was in school and could not be doing with Postal Orders when ordering computer games by mail order. (Didn't have a cheque book). It's easier than people think to obtain services by deception and I would be interested to know how many people under the age of 18 have obtained lines of credit.

    I myself lied on applications, when trying to obtain a bank account some time ago. I would lie, and miss out addresses which I knew I had bad debt at, this obviously came back and bit me hard on the aR£e I couldnt even get the most basic of basic bank accounts, and if memory serves me correctly I had about 20-30 CIFAS markers on my credit file.

    I have learnt from that experience, and now am 100% accurate with the details I give, and I check, and check again to make sure the info I give is correct, trust me a CIFAS is the last thing you need!

    Everything I wrote on here is true (like it or not), dont care what you think 'right or wrong' I was just asking a question.. dont know why some of you are on here if you are not dispensing advice. (probably nothing better to do, I can only assume)

    We cant all be as lucky as some of you people, I wish there was some way of me showing you that what I have said is true.. and by all means if anyone thinks of a way let me know..

    too many 'irregularities' to make this genuine?? do you honestly think I have nothing better to do then make up stories?

    I wish it wasn't true, but it is - nothing more I can say really.

    This forum is riddled with people who post just to wind people up and pass judgement on people.My advice is take heed of those who give you good advice and ignore those who are simply trying to get a rise out of you.If you respond to them you are playing into their hands as they want an argument.No matter what you say you will never be able to satisfy them.So dont explain yourself to anyone and take heed of the sensible advice some people give you,

    You now have to pay it back like the rest of us.

    Why should you get the debt cancelled because you lied? Madness....

    I got into debt before i was 18

    at 16 i had £4k of debt. Now i am paying the price and paying it off. I asked my bank for a credit card for emergencys and they gave me one with a £800 limit 2 days after my 18th birthday. I signed upto Littlewoods to buy 1 thing from there for my gf costing £12. They offered me lots of pay 60p a week for 20 weeks intrest free etc and they gave me a £1k credit limit without me asking. Not used it and dont plan on, could come in handy in future years when i move out, for getting a washing machine or something if it was really urgent.
    Anyway im getting off topic here, my 2pence worth is, you got the credit, you used it up, now pay it back. So many people seem to want money for nothing in this world. At 23 you really should know better.

    If you were still under 18, you would have an argument for having it written off as you would not be considered responsible for it....

    As you are not and you have been spending since, you don't really have any argument imho, by continuing to use the cards you have been saying you accept the agreement surely?

    Your only avenue would be to SAR them and look at the credit agreement, then play the "my signature wasn't valid as I was under 18 at the time" game, but then... the bank DO have an argument for you acting fraudulently, and you are better off with some debt than a criminal conviction for fraud.
