""Whilst the tenants’ rights are automatically protected under the tenancy deposit legislation, meaning that the schemes must pay out, landlords have no such rights. Their only recourse is to claim on the agent’s client money protection policy –but if the agent has had its membership suspended by NALS or similar, that protection will have ceased on the day of suspension.""

heads landlords lose tails - landlords lose
  • i recently served my tenants notice, went to court on 11th december, ll have to pay everything up front. you are liable but the judge will decide what the tenant should pay when the case goes to court. my tenants were told that they will be charged interest, part payment of my costs and charged so much a day if they are not out by the time the next months rent is due.
one of my tenants arrived at the court, admitted all was her fault. has been ordered to move out and contact me regarding payment. obviously we knew none of this would happen thanx to everyone on here. so we have now next week got to contact my solicitors who will then get the court bailiffs to go in and evict them from my property.
the council have not rehoused her as she has made herself homeless, she told the court her and her son are renting 2 rooms from a friend as of the 20th january. she was ordered to leave our property by 28th december.
she was trying to claim housing benefit and disability allowance but we had no contact from her whatsoever regarding her rent. now we have ended up with her being in 6 months arrears which includes the time that we served notices and gone to court. hopefully we shall have our property back by the end of january.

    i wish you luck.
