having served notice to the tenent, I am expecting him not to go quietly!
If it ends up going to court, who pays court costs, myself or the letting agent who selected him for me?

To all intents and purposes the letting agent IS you, he acts on your behalf at all times, any expenses he incurs (e.g. agreed repairs) will be charged to you as the landlord. It is you who is contracted with the tenant, you who is taking the tenant to court and you who must bear the cost. The only way you could have a claim against the agent is if you could prove that they agreed in writing to carry out certain vetting procedures and failed to do so.Declutterbug-in-progress.⭐️⭐️⭐️ ⭐️⭐️0

You pay your court costs. You can reclaim them from the T in cases of T fault (eg a S8 possession hearing plus outstanding rent claim would include a costs order against the T).0

If you want to claim against the Letting Agent, that requires a separate case with the Letting Agent as defendant, assuming they don't settle your claim out of court.Hi, we’ve had to remove your signature. To be a letting agent...
a) You need no qualifications (no, none!!)
b) Nobody needs to oversee or regulate what you do...
c) No Criminal records check is needed...
Anyone posting on MSE could become a letting agent within 30 minutes.

Might be handy to see if they've any convictions or complaints made previously about fraud, theft, burglary, deception, violence against previous tenants etc. And I'm sure plenty of tenants would like to know if the nice man with the keys to the house is on the sex offenders register.""c) No Criminal records check is needed...""

I had to be CRB checked when i managed a house in a Selectively Licensed Area in an inner city location - it was part of the License application formalities.
My arguement there was - when would i EVER be alone with tenant's children so why should i need CRBing - never is the answer....
CRB checks could, using the argument earlier in this thread, be forced upon Utilities Meter Readers, Electricians, Gas ENgineers, Decorators, plumbers etc etc etc - in fact anyone going into someone elses home....
the latest madness re CRB i came across was a local college insisting that stuents over 18 had to be CRB checked at their own expense, because some students in their class were under 18.... so what is the purpose of Teachers if not to supervise students ?? the world has gone mad.....0
