Inherent fault with electrical goods but retailer doesn't exist anymore - help!

    Credit cards are not an option.

    If it is the case that there is no recourse, it's a huge gap in consumer laws surely?

    Also Sony recalled the units themselves; the retailer is not involved at all. Hence my OP.


    The SoGA is with reference to the retailer, (NOT the manufacturer), the retailer has gone, so therefore have your rights under SoGA,unless you use a CC,( which you did not), and the value is between £100.- 30000.

    It is out of warranty, so the manufacturer has no obligation to fix FOC, (you could try pleading to their better nature, assuming they have one?).

    You appear to have 3 options; -
    1) go with Sonys offer.
    2) have it repaired elsewhere.
    3) bin it.
    Don`t steal - the Government doesn`t like the competition


  • It's really annoying.

    The simple fact is that an alarming amount of Bluray Discdrives have failed at the same time. Coincidentally this has happened after a firmware update.

    A firmware upgrade certainly doesn't determine there is a fault either. It could be just for an improvement.

    Inherent = there at time of purchase.
    If that is the case, how is it out of warranty before you complain?

    This is a total 'NO GO' and you dont really have a leg to stand on.
    So no-ones ever succeeded under the SOG act, because you cant prove it?

    I'm not going to join on the mean spirited band wagon, but I would suggest that you get a Credit Card, even if you just buy expensive items with it and pay them off. Anybody (and I mean anybody) unless you are bankrupt can get a Credit Card.

    As for the item in question. I think you are flogging a dead horse or a dead PS3.
    To get anywhere near to compensation you will need an independent engineers report to wave at Sony, and then possibly the small claims court. I'd pay the upgrade or get a Credit Card and then buy another!!

The reason is my now ex-wife had a better divorce lawyer than I did and I was made bankrupt. Although now discharged I can't, nor do I want, a credit card.

    Rather than hijack the thread and tell me to go get a credit card, assuming I am stuffed wrt to getting a free fix let's get a debat going.

    Because liability has to stop at some point. Otherwise its not fair on manufacturers. You were just unlucky to buy from a bad source.

    Small claims will end up in wasting more money. Even if you did have proof of the inherent fault, which you don't (i mean proof that would stand up in court not hearsay)

    And thank you for telling us, its no good asking us to search the forums looking for why you cant get a cc, your asking for advice, why should we go to extra trouble when you could have just told us?

    As for the future, you may try to buy items on some form of credit, if obtainable, as s75 protection would still apply.

    As for this situation, give up, pay them the money for the replacement. or ask if there's some way it could be discounted towards a new ps3 from Sony direct. OR just dont do anything and get on with the rest of your life.

    SOGA is a very valuable law and offers far better protection than alot of other countries so dont feel to sour about it.

    You purchased a PS3.
    Your contract/deal was with the vendor.
    The vendor no longer exists.
    So just who do you propose getting some satisfaction from?
    Sony owe you nothing. Sony's only responsibility is to their customer... the now defunct retailer.

    Oh, and what 6 year law? If you are thinking about the Sale of Goods Act, then any redress through that disappeared with your vendor.

    This has all been said before on this thread. Which bit didn't you understand?
