    Difficult to say, theoretically it should be an open and shut case as the collapse is widely reported, but in the case of XL some peoples cases dragged out longer

    My mate put down a deposit (more than £100) rather than a full payment with his CC for a holiday next year through Flyglobespan.
    Is there a chance of him getting his deposit back and if so how would he go about doing it?

    Guys read the above. contact your bank tell them you wish to raise a chargeback for Non receipt of flight.

    easy as that doesnt matter how much it costs. Section 75 doesnt come into play where the is a chargeback available.

    All this stuff posted just saying claim under section 75 is not the correct way. If they were more clearer they should simply state contact your card issuer for a details in regards to a chargeback for the payment concerned.

    Anyone who paid on credit card will get their funds back. No issues.

    That is a relief. I contacted Nationwide Credit Card customer services today and the person I spoke with was just awful to me - so rude and unhelpful. He just kept saying I could only make a claim via Citizen's Advice Bureau, which is a load of nonsense. Then he kept repeating "We at Nationwide do not know how you can claim for Section 75". :mad:
    I've used Martin's template letter and posted it away to Nationwide today. Fingers crossed.

    It is really easy and really pain free to get the documentation required for a chargeback.

    Only time section 75 comes into play is if the chargeback is out of time. Or there is not a chargeback right available.

    This is not the case with these Globespan payments.

    If you paid via travel agent you gotta claim via the CAA.

    If you paid money direct to Globespan for flights and or package contact card issuer get the ball rolling. Dont let them pan you off, I cant see why they are anyways, they arent loosing any cash, the funds get punted back to globespans merchant back which is some German bank so it makes no odds.

  • Paid £106 deposit for a package holiday next October using my Visa debit card. Read on here that I may be able to claim back through the bank as it's Visa. Asked at Bank of Scotland today but they didn't hold out much hope. Not sure which way to go now.
    If I had known then what I know now . . .

    Contact your bank. They have a chargeback under the Visa Debit card scheme for non receipt of service.

    I dont know the number for them but contact bank account general enquires and they should get the forms etc out for you.

    I phoned the helpline number for the bank tonight and got more information than from the branch!!! She took the date of booking etc. and did it all over the phone. Also said I'd have to get in touch with ATOL too.
    If I had known then what I know now . . .

    We got stuck in Tenerife on Thursday after being told at 15.36 by Globespan the day before that there was no problem other than our next flight in February changing time. Tenerife airport very little help apart from a briefing letter which told us we had to make our own way home. Went to Easyjet and tried to book to Gatwick only to be told my credit card which was actually in credit was refused so had to use Visa debit card for this and onward flight Glasgow. On return home MBNA took details for claim back of return flight and further one booked for later but said the card had been blocked by visa at the time I tried to book with Easyjet. This stinks as section 75 also says any resulting extra expense found necessary to return home would be covered and of course MBNA will not cover this now as I did not and could not use the card. The card is now annotated on their system as lost/stolen which is rubbish! It looks like Elias Elia is in this mess up to his neck!
