Carphone Warehouse Tariff Change Fee

Hello,
I currently have a mobile phone on the O2 network through Carphone Warehouse. I was on an 18 month contract, paying £25 a month, which has just ended. I was getting a £5 discount which has just been removed so my monthly cost has gone up to £30
I want to upgrade to the N900 when it's available, but in the meantime I noticed there is a monthly rolling O2 Simplicity tariff which would cost me £20 a month instead of £30, and I would still have the opportuntiy to upgrade whenever I want. All good so far.
However, Carphone Warehouse are telling me they must charge a one off fee of £19.95 to move me onto that tariff and keep my number etc... Is this allowed? I thought once you were out of contract they were obligated to move you to another tariff for free?

Afaik it is not a change of tariff fee, they are charging you for a new sim card. It may be possible for them to remove this cost but I guess it will be down to the particular advisor you speak to.0
