Maintenance arrears worries & future cost *advice needed*

  • What if i phoned the C.S.A and explained that i'm going for access and trying to sort maintenance and see if there is a file for me on the system? I wanna do it but until feb i'm not in a financial position to make an arrangement. I'm not some young !!!! thinking he knows best, i'm not a father who doesn't give a damn about his son, i'm not walking away from parental responsibilities and i want to form a relationship with my son and contribute to his upbringing financially and emotionally. How many monthers which there childs father would be like that? i'mtrying to sort this so the people who think i'm the enemy read all the post before you judge, i'm here for advice on the right thing to do

    Firstly you need to find out if/when the CSA have opened a case on you. Do a data protection file request - details in a sticky at the top of this forum.

  • I've just phoned the C.S.A and they didn't wanna know, I explained that my ex is on benefits and i'm trying to sort maintenance for my son so i needed to know if there was a case open against me for maintenance arrears and the lady on the phone just said they'd have contacted me by now if there was, they'd have gone to the tax office, got my details from them and contacted me that way. I tried giving my name to check but i just got the same response again, She said because i've not been contaced i dont owe anything but how can she know this for sure without checking if i'm actually on the system??? Ehat else can i do to find this out??

    Do this.

    Phoning them is a waste of time. A lot of the time they tell you lies on the phone. All contact should be in writing by recorded delivery. In any case getting your DP file (if it exists) will take a couple of months and buy you the time you said you needed in an earlier post.

    Can you not ask the PWC direct if she has opened a case with them. Tell her this is the only legal way you want to go regarding paying child support. No more back hander's!
    If you are serious about this all do things legal and above board so nothing comes back to haunt you in a few months/years tim.

  • I've phoned them again, this time the lady i spoke to was more than helpful, she gave me the C.S.A Birkenhead number where my details would have been kept on file, phoned them and my ex has been in contact with the C.S.A but hasn't requested any information pay related for maintenance, the chap i spoke to was more than helpful, all my details, my sons details and hers are on file, she contacted them last in august but there has not been any maintenance request made by her. There is a note now on the file that i have enquired about this and if we go through the C.S.A to arrange child support no back pay will be due, i'll only owe mainenance from the day the request of support is either made by me or her. They have all my correct contact details and would have contacted me about this by now.. I'm happy with there response and its now down to me to either arrange it with her or the C.S.A if needs must.



    As i said at the beginning of this there is 2 parts, the 2nd part is for once access is granted-

    as i'm in the army and live in camp 50 miles away from my son, for me to have him over night at weekends and on leave i'll need to rent a property near where he lives to make this possible. Besides the +/- 52 nights 1/7 reduction in maintenance is this recognised as by the C.S.A as an expenditure on his behalf??

    And this might not be the right section (if it isn't and you know which would be please let me know ta :-) )
    But because of the circumstances of which i'll be renting a property (weekend/military leave use for contact) am i entitled to any reductions rent/c.tax etc..?

    I dont think the csa would take that in to account as it will be a percentage of your earnings and housing costs aren't considered.

    I would have asked them to start a case from now, at least then you know where you stand and you are showing you are willing to support you son, she would also not be alble to say, either now or when he asks when hes older, that you didnt provide anything for him as it will be recorded.

    You will be entitled to a single occupancy discount on your council tax,I can't remember if you said your age :o but if you are under 25 you will only be able to claim a bedsit rate. Over 25 it would be a one bed rate although whether you qualifiy or not is a different story. Have a look here:

  • I've just checked up on council tax, because it's not my permanent residence i could be entitled to a 50% reduction as i pay council tax contributions for living in camp. Whether that applies being 24 or not i'm not sure but i'm 25 in summer so it wont be a great hardship. Whats good is a 1 bed place for an under 25 as a permanent address for contact?? lol.
