  • That wasnt the point of my post?! I dont understand why the doctor says s/he needs to dictate a note when mine had a form that took seconds to complete.

I don't know either. that's what has happened though. I now have my dictated note (£14.50 worse off), have returned it to my employer and they still won't allow me to return, because it doesn't specify I am fit to drive, even though I made a point of this in my letter to my doctor asking for the letter.
  • OP you really need to speak to ACAS

I'll be on the phone first thing in the morning. As well as annoying my doctor again.
  • I have since stopped taking the Co-codamol, replacing it with paracetamol and have also informed my employers of this, but they still want a doctors note to say I am fit to drive. I think they should arrange an OH assessment themselves. Still saying they won't pay me and I must get another sick note, which my doctor has already refused me.

    Well what do you expect

Your not able to fulfil your contract. No one is going to legitimately ok you to drive until you are fully recovered as if you crash they will be liable.

Nope. Just had them on the phone. They said I'll have to get a sick note for this period until they decide to let me back. I'm beconing stressed again. I really don't think the Doctor is going to issue a sick note when he's said I'm fit.
They can't have it both ways. If you are fit, you must turn up and let them send you away. If you are out of sick note and the doctor is not giving you another and you are available, then it is the employer who is stopping you working. They cannot expect you to deliver another sick note. They must arrange the OH assessment

OK then brains! WHAT do I do?

I'm not being paid, I can't get SSP for what it's worth and I'm not allowed to return to work.

If this continues, all of the above mean I can't pay my bills, I'll eventually lose my house and then what do I do? should I become a bum? would that make you happy? I very much doubt it.

Do I have any rights as an employee, or is it all complete flannel, and when push comes to shove, I'm genuinely screwed.

Read this if you can be bothered: http://www.patient.co.uk/doctor/Fitness-to-Drive.htm
and tell me at what point I am not fit to drive, therefore, unable to fulfil my contract. Please refer to the section on drugs.

It is my decision if I am fit to drive. I have reduced my medication, even though I had very little side effects. I have informed my employers that I have reduced my medication. They are refusing to allow me to work and they are refusing to pay me and they are requesting that I sort it out. I believe they should provide an OH assessment at their expense ASAP if they are so genuinely concerned.

Not sure why they should pay for it, your illness so you prove you are safe to go back to work. Either way I thought you were getting a certificate to say you were fit to work from the Dr's? Has this changed?

It may be your decision to drive again but as you keep seeming to forget if you had an accident soon after coming back to work the company could be in trouble....as I said how does the company know that you just didn't go back to the Dr and let the sick note run out and actually you could still be ill?
    Always ask ACAS

    go to the doctors office

explain exactly what wording needs to be in, even have it written out so they can copy it

    pay another £15

    do not get sacked

    no, it's not fair

yes, throwing money at this problem will make it go away

if this will not work then go and see a private doctor which will cost more but get you what you need
