So the employer is quite clearly worried that you may suffer side affects making you unfit to drive and work.

If you kill someone they are jointly and severally liable.

I very much doubt a local GP or occupational health will sign off on a return to an industrial driving job whilst heavily medicated.

I've had to take some time off work because of a painful foot condition, Plantar Fasciitis, which has eased up a bit with the rest, but not totally. I work as a driver fitter and my job aggrevates my feet.

My employers, now won't allow my return even though my sick note has expired, saying they have a duty of care. They want a note from the doctor to say that I am fit to work with my condition and taking my medication, Co-codamol and Diclofenac. I've already asked my doctor and he said the fact that the sick note has expired is enough.

My employers are still insisting on a doctors note to say I am fit.

    What can I do, I can't win!

Quite simple really, you ask your Dr to bill you for the note confirming your ability to return to work, your employer is required to pay for it as it is at their express wish. If ytour Dr declines, then suggest your employer pay for you to visit a private practitioner - again at their expense.

Personally if driving was my job and I was taking diclofenic and co-codamol then I woudln't be able to work, in fact I wouldn't be working in my usual office job, both of these medications affect me quite badly in a nausea/dizzy kind of way.

  • I am also taking Co-Codamol and Diclofenic following an eye operation, and although they do take the pain away, i don't actually have any other side effects with the tablets, so i think perhaps it depends on the individual.

It sounds as though your employer is just covering their backs, should you need to go off sick again, and especially so that you cannot claim that doing your job made the problem re occur.
Can you contact the Practice Manager of your surgery or your local health authority for further advise?
  • Just to let you know, The receptionist at my Doctors has siad he'll do me a 'fit' note, but it mightn't be ready until Thursday evening, Because he is really busy at the moment, he'll have to find time to dictate it, then it'll have to go for typing, then it might end up at the bottom of a pile. etc etc. then they're closed on Wednesdays. I tried pushing her to get it quicker but didn't seem to get very far.

OK, so while I should have been back at work on Monday, I'll not now be back until Friday. Where do I stand with my pay. I have been on SSP, which I will only be paid up until last Friday. Am I entitled to full pay for the whole of this week or can they just pay me for Friday

They probably are. I get the feeling that they're just trying to find a way to get rid of me now like a disposable piece of machinary that has broken. They sent me a letter while I was off sick which basically said get back to work or we'll fire you. I know that my foot condition will eventually flare up again when I go back, so I'll probably have to go sick again in the near future. And then they'll threaten to fire me again.

For goodness sake, can't you write the note, and just ask your doctor to sign it.

Seriously, how do you managed it everyday life as an adult?

Do you come on the forum and ask if you should have warm or cold milk with your Weetabix each morning?

yes, because a doctor will sign anything you shove under his nose.

Not a helpful post at all.

The Med3 form does allow for the GP to state that the patient need not refrain from work. I don't understand why the GP will not issue this?
    Gone ... or have I?

I'd have presented myself at work each day; fit and ready for work...personally.

And brought my own [warmed] milk in a flask for my weetabix.
