    The OP never said he had a "tag removing magnet", nor did anyone else. The OP said he had a magnet, the manager tried to imply that he intended to use it to open tags. This does not mean it was an actual tag removing magnet, made specifically for that purpose.

    How true - it may just have been co-incidentally able to do that

    I think you should go to a lawyer. Some possible things spring to mind, unlawful imprisonment by Tesco aswell as assault. Specialist legal help should be something to consider (you wont get that on these boards).

    To answer this properly,

    1. A security guard cannot lock you in a room nor can he detain you without your permission.

    2. A security guard cannot use 'excessive force' (note the word excessive)

    3. A security guard can DETER you but can only stand in the way of an unlocked door (like body block you)

    4. If whilst being detained you need to the loo, the security guard has to let you go but can stand with the door open whilst you're there

    5. A security guard can refuse to let you smoke whilst detaining you

    Basically, the laws are quite simple in that anyone can make a citizens arrest but it is how the arrest and subsequent holding of the citizen that will come under scrutiny.

    The old bill generally cover security anyway (i.e. take their side)..... :D

    A security guard can't detain you with your permission, but he can "refuse to allow you to smoke". Who gave security guards the power to decide who can smoke, and where and when?

    What is the punishment for smoking when a security guard has refused you permission?

    So, a security guard can use force, but not excessive force. 3 says he can only stop you getting away by standing in front of you, so where does the not-excessive force come into play? Stopping you lighting a fag?


    So in this instance, had the OP and his wife walked away the store staff and security had no right in manhandling them and as such, common assault charges can be brought against both tesco employees and the security.

    It is strictly forbidden and illegal.

    Which law says this is illegal?

    Don't even need to have passed all options to pay, removing a security device and secreting an item about your person or possessions could and most likely would be viewed as acts intended to permanently deprive.
