Sainsbury's credit care insurance - I never signed that part of the Card Agreement

Hi, I have had a Sainsbury's credit card since March 2003. I wrote to them asking for a copy of all the information they held about me. I got this information this morning
In amongst the information is the Visa Card Agreement that I signed for the credit card. There is a section titled payment protection and basically I had to tick the box and sign next to it saying "I want you to arrange credit care insurance to protect my payments"
I have not ticked this box or signed the box. I did sign the credit agreement accepting the credit card and stating that all details were correct.
I can't even remember agreeing to this. I doubt I would have agreed to it over the phone. If I agreed to it on the phone then surely I should have signed a document. Nowhere in all the information they sent is a document saying that I agree to pay their insurance.
Does this mean I can claim my money back. From all the information they sent, they cannot prove I agreed to it.

No. For many many years now, there has been no requirement to have a signature on general insurance contracts.From all the information they sent, they cannot prove I agreed to it.
Nearly 7 years of paying it though means they have good grounds to think you are trying it on. They may decide to cave in but they may also decide that there is no grounds to refund.I am an Independent Financial Adviser (IFA). the agreement did not say how much I would be charged for the credit care or if they charge interest on it0

I have a nationwide credit card and like you i never signed the PPI on my agreement, i called nationwide and they told me it may have been applied when i called to activate the card. i told them i can not recall this and told them to prove it that it was sold to me over the phone when i called to activate the card, they said thaey will look into this and get back to me. after a week i got a letter saying that they refund all the money back to my credit card, as it was mis-sold to me
ever if you call to activate your card they still should have told you that it is not a must you have to have it, you have ever right to reclaim this money,go for it!!!0 -
I don't think the insurance was sold when I activated the card. I have a transcript of all the phone calls and letters and there is nothing mentioned about the insurance.
Do I go down the route of saying this was mis-sold to me and use the template letter on this site or write my own letter about how I did not ask for the insurance and did not sign that part of the credit agreement?

weebubbles - I had PPI applied on my loan when the agreement (which I asked them for a copy of) proved that I did not tick the box.
I recently wrote, using the 'mis-sold' template letter, but changing it to say 'I never even ticked the box!' They wrote last week to say they are paying me back all the PPI I paid. :T
This is the letter I wrote:
Dear Sir or Madam,
Agreement number: *****
I purchased the above loan from you on 21st March 2006. Looking recently at my statement, I now realise that a payment protection insurance policy (‘AA Creditcare’) has been applied to the loan since the commencement of the agreement.
As you can see from the attached copy of my original signed agreement obtained from yourselves, I did not tick the box agreeing to purchase this policy.
Therefore I have been paying for insurance that I did not agree to, and did not know had been applied so could not have been explained to me.
Furthermore, I would have had no reason to purchase any kind of payment protection as I have adequate provision from my employer in the event of unemployment or illness.
I am requesting a full refund of all premiums, and subsequent interest on these payments, that I have paid to date. As I believe I have been deprived of this money I also expect 8% statutory interest, the amount a court would award, to be added to each payment made.
I look forward to a full and prompt response to this letter and for the matter to be concluded within eight weeks or I shall be contacting the Financial Ombudsman to investigate my complaint.

I obtained loan from Beneficial finance in March 2005. I remember being told that as the loan amount was so large (£15,000) and that I was applying on my own that they strongly advised me to take PPI as I might be refused the loan with out it.
Obviously I have recently found this not to be true. I wrote to them in early October using the template on here and received a letter from them mid November, which basically said while they didn't admit to the claim they would refund all the money paid and cancel the existing loan and start a new one for the remainder of the term without ppi attached.
I called them as was told I would have to wait 21 working days from the receipt of the forms I had to complete. With this time nearly up I have called them again and told it will be at least a further 2 weeks. The date they quoted me that they received my forms was 7 days later than the recorded delivery from the Royal Mail said they were signed for delivered.
Now to my question, can I hurry them along? I am still paying the monthly repayments including PPI while I wait for them to settle everything. The difference in payments is £80 per month so obviously I now feel I am paying out where I shouldn't have to. They have advised me that all interim payments will be refunded via cheque however surely the money would be better in my account than theirs?
Any advice would be welcomed

Yes that is right "its your money", tell them you want this paid out by 7-14 days as you need your money, or you will otherwise have to take this to the financial ombudsmans service (FOS), tell them you believe they have had ample time to deal with this and its causing you undue distress, also if this does end up going to the FOS you will also consider requesting for compensation for distress.
It is up to you, but please be aware it can be a while before the FOS deals with the complaint, a letter to chase the bank up will not hurt though, good luck and hope you receive your money very soon.:beer:The one and only "Dizzy Di"0
