Nokia n97 problems-where do I stand?

I guess there must be a few people in the same boat;
I've got a Nokia n97 on '3', and like many of them it has huge problems not least with hanging up and/or re-booting in the middle of a call. There is an update that has been released by Nokia in an attempt to address at least a few of the many, many problems the phone has. However, this update is not available on my '3' branded handset, and neither is there any information forthcoming from them as to when it will be. De-branding the phone will void the warranty, and if I send it back '3' will simply reset the phone, re-install the original firmware and say that there is nothing wrong with it. I'm sick and tired of all these problems, and the evidence around the web is undeniable that the phone just doesn't work, but how on earth can I get '3' to accept this and replace the n97 for a handset that works properly?

I agree with the above. I too have ahd numerous issues with this wretched phone and neither Tmobile, Beepy Mobiles (who I bought the phone form) or Nokia are accepting any responsibility; so I am stuck with a phone that's on the blink - constantly!!!!!!!!!!!

I exchanged mine for an HTC Hero with 'Three'. They all know about the problems. I sent the phone back to be repaired and it came back with other faults-the moment I turned it on I found that JAVA was missing completetely meaning I couldn't install virtually any game or application. The update is out for most handsets now but I understand it does very little to actually realise the potential of the phone.
My course of action was to take the situation up with trading standards (Consumer Direct). Once I had their advice (i.e. I had to give 'Three' the opportunity to repair the phone, or replace it with one of equal or greater value-which they don't do), and 'Three' were unable to repair it I could cancel my contract or negotiate a different deal, which I did.
The fact is that the phone does not satisfy the basic requirements of law:
"If you are buying a mobile phone, it must be of satisfactory quality, fit for its purpose and as described"
