Christmas day off - refused

    If she hasn't got any days' leave left I can't see how she expected to have any time off, Christmas Day or not!

    Sorry about your situation,
    Same thing happened to me, I requested, manager said he would try to be fair for everybody who worked last couple of years on those two days. But when it came out I realized he did not give it to me. I tried to talk to him but no way. He stuck with his own dicision. Then I went to higher management. So finally I hve got what I want. I was not unfair at all. I have been working since last 7-8 years on christmas and boxing day.
    Why can't she try this method?

    because she could have had it as her day off for that week, they cant expect her to work 7 day weeks every week. although having worked in a hotel i know they would like to!

    "There are special rules for shop-workers in England and Wales who work in large shops (over 280 square feet). If you work in one of these shops, you must be given Christmas Day off, regardless of which day it falls on. However, whether or not you will be paid will depend on your contract of employment."

    If you want to be with her on christmas day why dont you go with her?

    Might not be the fun family christmas you had planned but at least you will spend it together.

    It sounds like she's working a lot of hours - what I suggest is looking back over the past 3 months and averaging out how many working hours she has worked in that time. If over 40 hours per week, and if she hasn't signed any sort of opt-out, then they would be in trouble in respect of the working time directive. She might be able to get them over a barrel with this and make them give her Christmas!

    Has she been paid full pay for all the "holiday" days she has taken so far?

    If you are going to suggest blackmailing an employer, you could at least provide factual information in regards to the "dirt".

    The WTD is 48 hours a week, not 40. However I don't consider it "blackmail" to insist an employer sticks to it. It is there for a reason.
  • I think I'd be discovering religion. Christmas is the biggest day in the Christian calendar. Its against your human rights to stop you practising your religion.....


    Unless you work for 24 hours straight through on Xmas day (been there, done that....) you can still practice your religion. I'll only be doing 5 hours this year, plenty of time for pressies, food, church, walkies etc

    I might be working Christmas day and it doesn't bother me :D I am looking forward to wishing Merry Christmas to all our customers and wearing a santa hat.
