Car Refund

Hello all, a couple of months ago I brought a car from an independent garage, I was given a 3 month warranty.

Now it turns out the seller sold me the car with a faulty gearbox, it has already been to the peugot garage twice, its been to an automatic gear box specialist twice and its still not fixed.

Its gotten to the point where its becoming much more hassle than its worth, I was wondering when am I entitled to ask for my money back?

The warranty is up the 9th of January, someone told be I have to wait until the warranty is up to ask for a refund, as while its still under warranty I have to give him every chance to fix it. Which is a pain as it means I seem to be without a car more than I am with one.

    But you imply it hasn't fixed the fault you reported within the warranty period, which if true, means you are covered.

    What exactly is the fault? They could fit a replacement gearbox in a couple of days max.

    I think you need to move quickly on this one.
    The warranty you have is a dealer warranty and am guessing he has tried to get it fixed.

    He probably tried in house first time but way too complicated for them.

    It then went to Peugot twice - this suggests to me first time was quick fix and second time they were told it needs a new gearbox.

    Dealer that sold it doesnt want to pay that so then sends it to a gearbox specialist hoping for a cheap repair or refurb. He has twice failed to fix it which means it probably needs a new or refurbed gearbox.

    The dealer wants this problem fixed for just long enough for it to become your problem and not his.

    If I was you I would put a letter to him in writing (ideally via a solicitor witha copy to trading standards) explaining that the car has been off the road 4 times in 2 months with the same issue, that he currently has the vehicle, and that its not fit for the purpose it was bought and you would like your money back.

    He may well decide that its cheaper and easier to give you the money back and write the car off and send it to a stripper to be sold as parts than it is to fit a replacment gearbox.

    Worth noting that if you bought an idependent warranty for the car yourself it would probably not cover this as it may be seen to be a preexisting condition.

    Auto gearboxes are not cheap and you want this resolved well before the warranty expires.

    He could give it to you back on the 1st Jan and if it went wrong a month later it would be your problem and your bill.
  • Well last time Peugeot garage looked at it which was yesterday they sad it was a faulty vavle and would cost close to 600 pounds to be fixed. So I told the garage that and they are making me take it in to them so there peugeot specalist can have a look at it, yet again.

    I'm worried that as it's his own mechanic "fixing" it he may well just do a temp job so it lasts until the warranty is over.

    As long as you reported the fault prior to the warranty end date, you should be covered.

    Not the point.

    The selling dealer has accepted it is their responsibility to fix it under warranty.

    Agree but ensure you have records and documents that prove this.

    He could say it was a different issue thats now fixed and next months problem is a new one.

    Hence a letter trail starting now would be a good idea.
    Ask them to confirm to you what the problem is?
    How they intend to remedy this problem
    How long this remedy will take
    How they intend to compensate you for your inconvenience
    How they can assure you that any repair will last a REASONABLE period afte the car wil be out of warranty (ie can they extend the warranty)

    A faulty valve that costs £600? :confused:

    Find out from the Peugeot dealer the exact name of the faulty valve if you don't already know it and post here please.

    Then it's a simple case of ensuring whoever fixes it fits a new replacement valve of the type the Peugeot dealer claims is faulty. Confirmation of this should de obtained in writing from the fixing dealer.
