Abusive Landlord Taking Money From Credit Card without permission

    I recorded the last 4 conversations i had with him this past hour, and my other two flatmates who he has also rang while ive been sat beside them recorded theirs aswell.

    He rang them then rang me back to claim the other two were upset with me etc... What a loser.

    On top of that he has now said janurary 4th i "better have £900 in his account".... So im guessing his lawyers have informed him he cant kick me out as fast as he thought.

    And for the record having a 40 something abusive, loud scots man shout at an 18 year old girl living on her own for the first time in a city would be considered harrassment !!!!!!!

    Like your student status, your age, sex, location and being a novice tenant, has no relevance to your arrears and your failure to meet your contractual obligation. It is your responsibility to understand the terms of your contract and comply with them.

    The Shelter Scotland website will have a section on how to deal with harassment, how to deal with rent arrears, and a section on the law as it stands when it comes to being evicted or becoming homeless.

    Now, be careful with those recordings...
    a) Don't lose them...
    b) I think using them as evidence may be tricky... but offer a copy of them (keep your own copy) to the Polis (Scots spelling) if you speak with them..

    IIRC correctly (English Law, Scots may be different) you can't use recordings as evidence in court unless he-who-was-being recorded was told he will be recorded (usually "for training purposes"). The way to approach this problem is that, if it ever gets to court, you produce a transcript (typed version/..) of the conversation and give that as evidence: When Mr Dodgy Landlord denies he said it wave your iPod or whatever at him & the Sheriff and enquire, sweetly, would he like to listen to a recording....

    But please, make him an offer to pay something (that makes his position more difficult) and contact CaB or Shelter...

  • That you're a young girl and he's a grown man does not make any difference to whether you owe him the rent or not. I agree that he should be behaving in a professional, non-confrontational manner but you should have made arrangements to pay the rent due on time: that is not your landlord's problem, whether you're house-sharing for the first time in your life or not. If there was going to be a problem you should have communicated this in good time. I take it that the £600 is two month's rent, is it?

    Just some people thought calling the police was a bit OTT.

    You need to speak to your student welfare or accomodation office and send a letter re harasssment but you also need to get that rent paid PDQ. If you let the university know about the situation, they may move a bit quicker.

    However, you are only 10 or 11 weeks into the year and you are in dire straits paying your rent. How are you going to sort things out so this does not happen again next term and the term after?

    1. Using his ethnicity as a suggestion that it strengthens a harrassment claim is nonsense.

    2. Using your respective ages is dubious. You're both adults, you should both behave as adults.

    3. Did you let him know that you were going to be unable to pay your rent or did you just wait for him to contact you?

    4. Was his shouting/abusive call his first contact about the outstanding rent?

    5. Why are you referring to when he might be able to "kick you out", if you pay your rent he would have to reason or legal right to kick you out.


    Oh, and no-one on here can state that this IS harrassment. Not without full details of the conversation, details of exactly what was said and some reasonable evidence of the tone and manner used by both parties.
    I'd note that the OP didn't mention swearing, which imho would be a significant factor in determining it harrassment.

    Asking someone to pay the rent they'd agreed to pay but didn't is not harrassment.

    I was a student once! Part of going to Uni aside from the Course is to learn how to look after yourself. Rent / bills / managing budgets etc etc.

    I appreciate you are only 18 and its all new but as others have said to be in arrears of £600 in the first term is a downwards spiral. You have signed a contract agreeing to pay and you are out in the big bad world now so you have to take responsibility.

    If I understand your posts correctly there are others in the house owing rent too? The landlord must be tearing his hair out.

    With Christmas approaching can't you get some bar work or shop work to pad out your income and pay the LL his rent?

    I trust you are eating beans on toast and not drinking / going out to save money?

    No the others are not owing, just myself

    He has now called one of the girls to inform her that i was "going to leave you two in the lurch"

    Only for the fact the two girls are with me, this man is playing all sorts of mind games with us. It's actually very frightening i feel like he is some sort of mad stalker constantly on the phone to one of us.
