Hi,
I bought an Apple 4th gen iPod nano 8GB from Argos last December. The buttons have recently stopped working so I rang Apple and they arranged to send me a new one whilst I sent my old one back for repair. They asked for my credit card details so that they could take money from my account to pay for any repairs not covered under warranty. I was then informed that if my iPod was broken through my fault that they would take £120 out of my account. This is more than the cost of a brand new iPod which seems ridiculous, also I do not have this money to spend on a new iPod. So I asked if I would have an option to 'opt out' of this and have my old iPod returned unfixed if this were to be the case. Apple said that yes this was an option, I would then need to send the new ipod back and money would not be taken from my account.
Anyway, sent my iPod off, and had an email from them on Friday saying the iPod had water damage which was not covered under warranty and that they are taken £62 from my account. I rang them straight away to say that I didn't want to pay and could they send me my old iPod back to be told that my iPod has already been thrown away as that is their policy upon receiving a water damaged iPod.
Therefore, I now have no option but to pay £62 and keep this new iPod, which is actually a refurbished one. I was never informed that water damaged iPod would be thrown away and was assured that I could have my old iPod back if it was not covered under warranty. They have since denied this saying it is not their policy.
Where do I stand with regards paying the £62 or receiving my old iPod back? I have tried to contact CAB but they are always engaged.

Why would you want a faulty Ipod back?
I take you have already returned the refurbished ipod since you dont want to pay for it?
Normally warranties advise a charge for non covered items although you would expect it to be returned.
To be perfectly honest if your being offered the refurbished ipod at £62 I would take it as they probably would just return a faulty ipod to you otherwise and charge an inspection fee.
I don't suppose you checked the liquid damage indicator before you posted it?0 -
apple refurbs are as good as new so you really got a new ipod for a decent price0

I don't particularly want a faulty iPod back, but I would rather that than than have to pay £62 (which I don't have) for a refurbished iPod. My point is that they cannot throw away my iPod without my agreement. And yes I did check the liquid damage indicator which was clear, this is another issue altogether.0

It's really their word against yours as to whether you asked for it to be returned unrepaired, unless you have proof. I know that's pretty poor, given that they made the mistake. Well you can't do anything with a broken ipod. Sell the refurbished one on ebay, you'll get more than you paid for it and then put the money towards buying one when you can afford it. It just seems like you're complaining for the sake of it.0
