cousin survived redundancy but............

hello everyone,
the co.where my cousin was working have been carrying out redundacy/restructuring consultation.
as per the redundancy criteria she scored better than everyone in her group and hence survived the redundancy, however some some slightly senior position (more pay) in the co became vacant due to voluntary redundancy, these positions were offered to people who scored lower points (likely to be redundant) then her. while she is genuinely happy that she got a job, she feels that she should have been offered or asked to apply for the more senior positions. is she justified to make a case ? i just feel she should just get on with it, her manager was a nice guy and tried to minimise redundancy.
has the co broken any employment rule?

    Give people a chance, not everyone is up late!

    Every company is different but they should offer the senior position to all or thats unfair and if say your cousin got the job then someone likely to be made redundant would then fill her position instead if you follow me...

    Company I work for has been doing rounds of redundancies over the past 18mths and I expect will continue, we have an effective recruitment freeze on extra head count, for any new roles seen as vital those who are told they are at risk or are undernotice are given preference in applying for them. Majority at risk who've wanted to stay have managed to get other work within the company.

    It sounds ok to me it's in the interests of the employer and the employee as risk to keep good staff.

    she can complain but there's no legal fall back position.
    Debt free 4th April 2007.

    thanks guys.she is abit upset as all co pesnsion,bonuses etc are based on your salary and the basic pay difference is about 10k.she is going to see the manager.i thought what bigsteve said alot of sense

    Why should she wait to be asked to apply, why didnt she do the (either) asking if it was worth applying or just going ahead and applying.

    Many big companies offer new jobs to 'displaced' staff first. In some ways hard on those who don't get an opportunity to apply, but a lifeline to people who would otherwise be joining the unemployed masses.

  • I have seen this happen elsewhere..... jobs that come up through wasteage are first offered to people who are in the pool as formally 'at risk'. In many ways it is the company trying to 'do the right thing' with unintended consequences (i.e. that they exclude your cousin who has just fallen out of the 'at risk' pool).

    They are probably following process and just haven't considered the quirk they have created.

    Your cousin should simply speak to HR and make the following points:

    - She would like to apply for the senior position
    - She understands that it is currenlty closed for 'at risk people' for good reason, but if she gets it then her role will be available which is a closer match for the 'at risk' people. Therefore allowing her to apply has no negative consequences for the 'at risk' pool, as it will still leave one job open.

    The key thing is to make sure the request is to someone SENIOR in HR - and not just her junior contact who probaly has no leeway whatever and just follows process. The request needs to be to the HR decision maker.

    If she doesn't ask she wont get! Good luck.
