T- mobile / Carphone Warehouse
Hi can anyone comment: Have had a contract with T mobile in my name for my son to use. Cancelled contract phone to revert to pay as you go in 30 days. Day after son went into carphone warehouse who asisted him to upgrade contract which I thought was cancelled day before, issued him with a new phone and contract. They said ok to sign my name as he lives at same address. Contacted T mobile who said to take up with carphone warehouse, they say contact T mobile who will fill in form saying son commited fraud by signing my name. Want out of new contract. Have cancelled direct debit. Nobody offering any solutions???

Not entirely sure what would be best to advise. Technically it is fraud and you haven't entered into a contract yourself and if you have proof of this, it should be sufficient to cancel with the network. I would say you would need to speak to CPW first and foremost (The CPW Customer Services seem to be quite helpful from experience of them calling me at work with Customer problems). I think you would need to speak to CPW as they would need to have the contract cancelled with the network, and if one of their employees has advised your son it would be okay to do that I would especially take it up with the store manager. Persist with CPW first and foremost, as T-Mobile may be able to cancel the contract but you may end up being charged for the handset which you don't want. I don't have the CPW number to hand but you should be able to find it from the Carphone website.0

How old is your son? If he's under 18 then he can't enter into any form of contract!
CPW may think they are being helpful allowing your son to sign for you, but they're misguided.0 -
They should never have advised your son to sign for you, as they would do a credit check on who the contract is for, so he isn't allowed to sign for you.
I would inform T-Mobile of this as i assume you have already done, they cant hold you to a contract if you didn't sign for it. And then take it up with the store/area manager of carphone warhouse, that you did not sign for the contract so it is not valid, and that your employees should not encourage customers to sign for a contract in someone else's name.Although no trees were harmed during the creation of this post, a large number of electrons were greatly inconvenienced.

I'd suggest contacting T's fraud dept, but as their outsourced that may not get you any where.
Next best bet, go with DC's advice above, go into store and be VERY loud about what's happened and how their staff have advised your son to commit fraud, that should get you a result...0 -
Your son should never have been aloud to get the contract at all in my opinion. Not sure of CPW policy but through T-Mobile stores only the account holder can take an upgrade. And proof of i.d is required. I would say CPW are at fault here. The should reverse the upgrade and they should inform t-mobile for you, by sending a reversal for which the can do but it seems to be some sort of inconvience to them as there stores only seem to be interested in getting you into a contract. Im not sure exactly what the form is they fill in is though.
3rd partys continually pass the buck onto the providers when they are actually at fault in most cases i have came accross.0
