Car - Ebay Cat C not on listing

Hello just bought a car on ebay after looking at a couple which have been SORN, got email to say best offer accepted, but decided to run a RAC HPI check to be on the safe side and discovered it has cat c.
I haven't paid, am i still in the right to be able to now walk away? I am not really bothered if i get a neg feedback and i really dont fancy the hassle of going the vehicle inspection.

    You should check before you bid, the seller doesn't need to tell you.
  • It's my understanding that it's a binding contract once you win the bid on Ebay. I'm sure someone will correct me if I'm wrong?

    However, putting that aside I would contact the seller and explain why you are not going to complete the sale.
    Why did you not do an HPI check before you bid?
  • yes i have replied to seller and informed them the reason why i am pulling out, i have been after a number of low value cars and not one and at 6-10 pounds a HPI check it gets expensive if your not successful. Not had reply back off seller yet though.

    to be fair thats exactly how i feel, but i haven't had much experience of feeling the wrath of Ebay

    Does it by any chance say "car advertised elsewhere so listing may be pulled"

    I would have thought that such a wording which is on many listings in ebay might void any contract you have with them. i.e. if they can unilaterally pull out of the deal then that privilege ought to be given to the bidder aswell.

    Unfortunately you entered in to a contract, the seller does not have to declare everything, so unless the seller lied to you, then you have purchased the vehicle by bidding and winning.

    Expect eBay to at least close your account if you intend to back track on the deal.

    Ebay do not care about buyers refusing to pay, if the seller complains they will merely tell him to go through the full dispute process to reclaim his fees and give the buyer a strike.

    One strike will not harm a buyer, two will though as most sellers have their preferences set to exclude buyers with 2 or more strikes. No one apart from a court order can get a buyer to pay , just as no one else can make a seller sell if they refuse.

    is it in damaged state and not mentioned in the listing?cat c doesnt really mean it was in an accident may have been stolen and recovered an only needed a window and barrel. if been in accident then repaired then may have been put through the VIC test and wont need another vic test, you could ask seller what damage it had if any and if it had a vic test.

    people slate others for not HPI'ing a vehicle and then later on discover things like this. you did all beit it was on ebay at least you havent handed any money over in the end of it if you pull out you may end up paying for the sellers listing cost. but at least it wont be as much as a possible vic test. gd on you for hpi'ng the car at least you know it is a cat c.

    acccident damage for a cat c can range from just a bumper to few panels being damaged to stolen recovered and never actualy been involved in an accident.
