    Thanks i hope so but then again the owner of the home does like to cause problems with ehr staff:rolleyes:

    Just an update and some help please:)

    She handed in her notice yesterday and told them she has the two weeks summer holiday's left so will take them on the end of the four weeks leave,so two weeks working and then take the final two weeks an holiday's.They told her she can only have one week.Is that right?
    I think,i'm not sure,that they mentioned something about as we aren't half way through the summer holidays yet(they have to take summer holiday's between 1st April and end of Sept i think) she can only have the one week.

    Does that sound right or are they trying to fob her off as they can't be bothered trying to get cover and pay for that cover aswell as paying her?

    In most companies you acumulate holidays usually say 1.5 days per month. Obviously if the company waits til everyone has acumulated their holiday entitelment all staff would be off at the end of the year. It is normal for you to be told you can take the holidays like your partner but if she had taken her 2 weeks and then left she would have owed them uholiday pay back and theyw ould take this from her last salary.If you she was working a full year ( eg April to April ) she would not even know this but if say you she gets 4 weeks holidays per year that means by the end of June she has acually only acumulated 1 week.

    When does her holiday year run from? You should be able to calculate how much holiday she is entitled to from this - so if half way through the holiday year she would be entitled to half the holidays.

    It may be worth speaking to ACAS or the Citizens Advice

    Well you ought to find that out in order to know how much holiday she is entitled to!

    For instance my holiday year when I was working ran from April to April but my sisters ran from January to December - so it will depend on that as to how much holiday she has accrued so far

    All we know is you take your summer hols between April 1st and Sept 30th and then the winter between the others.

    Is there nothing in the contract to say when the holiday year runs from and to? If not then it will probably be a tricky one to argue for two weeks holiday rather than one.

    just a quick question while on the subject.

    what happens if a company has a 1 months notice policy,but you only give them 1 weeks notice? (which would be a weeks holiday notice)

    can they with hold any money owed to you? etc?
