Partner leaving her job

She is going to hand her 4 weeks notice in which she has to work as they held back a weeks pay incase anyone leaves early.Anyway she works in a care home as a care assistant but is going to leave to start a new job doing home care.What i want to know is is there anything stopping her from putting in her 2 weeks summer holiday that's owed so work 2 weeks and then have the final 2 weeks off as holiday?
I don't think there is though i wouldn't blame the owner if she wasn't best pleased:D

She should be able to either take it as paid leave, or be paid for it at the end of her period of employment. Certainly she's entitled to it one way or the other!Signature removed for peace of mind0

She's defo entitled to holidays, although I know where I work, we have to put our holidays in at the start of the year, before it can be decided if they are to be honoured. To cover business needs etc.... your partners employer may argue that given the short notice, and it being the summer, that holiday leave cannot be taken. On the other hand, if she's leaving the job anyway, her boss may say thats its ok for her to use her last two weeks holiday, at least your partner wouldn't need to worry aboiut getting her holiday pay wich is owed to her. I know some care homes aren't very good at the personnel side of things and it may be that your partner would have a struggle getting what was owed to her. She should still be entitled to her holiday as either pay or leave but don't forget if she leaves her job half way through the year she will have only earned half a years entitlement less what she may have already used.
I always think you want to make your exit as smooth as possible; you never know when you may need to go back, or ask for references or even when you may end up working for that person again somewhere down the road!

Remember that holiday is pro-rated though... if she is only working 1/2 the company year she will only get 1/2 her annual entitlement so need to make sure how much holiday she will have left before she starts booking it.
Certainly she can book a holiday and then resign after it is agreed but as with any holiday booking a company is not obliged to agree it simply because it has been requested.
If she doesnt want to work the 4 weeks notice it may be worth while her discussing if this is negotiable when she resigns - though of cause if they waive the notice then she doesnt get paid for it.All posts made are simply my own opinions and are neither professional advice nor the opinions of my employers

They normally say she is supposed to give 4 weeks notice for holiday dates to be given in but i read her contract the other week and it says in there that only two weeks notice is required.Darren0 -
