Double take photography make over day scam

Options
Hi I wondered if any one knew how i could get my daughter her money back from these cunning misleading robbers. She was telephoned by a friend to say that she had given double take her phone number because they said they were doing a special makeover day with photos for £25.00 so my daughter rang them and booked and appointment. Double take charged here immediately £20 which they took on her debit card for her and her friend as a booking fee??? Her friend then wrote off her car and asked my daughter to cancel the booking because she full of cuts and bruises etc. so my daughter rang explained and asked to cancel the appointment. She told her she was out of the seven day cooling off period and it would cost her a further £25.00 each to cancel.
If she left it any longer to cancel it would cost her more abouyt £125.00:mad:. So she paid it with her visa card. I just couldnt believe that this company could do this. She hasnt signed a contract with them, and didnt receive a copy of their terms and conditions until the day after she cancelled. Is there anyway she can get the money back it just seems so unfair that she has paid out £70 for absolutely nothing. the appointment was made on the 14th of november and cancelled on the 25th of november the actual appointment was not until the 8th of december. so it wasnt like she left it until the last minute to cancel. Any help would be appreciated thankyou

can the date not at least be changed for when your daughters friend is better?
btw - I went to double take, the pictures they took were average and they had messed up some of the styles in some of them, they really try and pressure you into buying, they left me and my friend in the room for 2 hours after we said we weren't going to pay for the pictures and then moaned afterwards that we'd wasted their time!!! I did get the sheet with all of my pictures on it which I managed to scan onto the computer for overall cost of £80 but realistically only 1 or 2 of those pictures I would ever use/display!

  • Thanku to everyone for your replies I was just hoping that someone may have a sort of template letter she can send quoting something legal they may have breached, because in most things the threat of court normally works. Dont know that much about the law though thats the problem, so i dont know what to quote?? Anyone any ideas???

Your not going to believe this but my daughters friend who has had her photos done already, rang to tell her it cost £4,000 and they did it on finance for the pictures she wanted. I nearly fell over!!!!!!

No lower limit on a chargeback....so still covered.

[You are correct to some extent in that Section 75 does indeed have a lower limit of £100...although interestingly that's the 'price of the goods/service, not the amount paid by cc'....so even if it's only £2 on the cc, as long as item costs more than £100 you're covered by section 75]

Blimey o-reilly.. for that sort of money I could buy enough top-end photography kit to open a small studio

Sounds like your daughters friend is exceptionally gullable

edit: i'd start with one of these - http://www.reghardware.co.uk/2009/12/04/review_camera_nikon_d300s_dslr/
