worried about debt collectors

I'm only a young lad with a low income, I'm a carpenter and work has gone to 0.

I took out an original £200 credit card with capital one and struggled to make payments. If i rang them up they never seemed interested inletting me pay a smaller ammount so i couldnt pay and the interest and late payment charges ketp rising.

As it stands it is now at around £600 on charges. I have easily payed off the original £200 by now.

The bottom line is i couldnt repay the money with no income, they didnt seem to care & i just burried my head in the sand hoping it would go away.

They want me to pay £90 a month starting tomorrow but i have no income for 2 weeks. They said if i dont balifs will come around.

I contacted financial advice and waiting for an appointment. But if i dont pay the balifs will come around after tomorrow.

i want to pay them but i just dont have the money right now.

I dont know what to do, it's keeping me awake at night

    Borrow the money from parents, get an overdraft or phone CapitalOne and explain your situation and advise them you cannot get money that you do not have.

    They will not send the balifs around. You'll have to receive a default notice and other steps before they can send the balifs. I believe they might even have to go to court first before sending the balifs.

    Try and borrow from friends/family. It's highly unlikely you'll get any credit/borrowing from anyone now, as your credit rating will be wrecked for 6 years.

    Rubbish!

    Pay them what you can afford. If that's £1 per month, so be it. You should justify it with a financial statement

    Before bailiffs, they would have to:

    issue a vaid default notice
    start a court claim, costing them money
    ask the court to turn down your response to the claim form
    win their argument with the court
    wait for you to default on the court order
    apply for a warrant of execution, costing them more money
    then the court bailiff could come around. He/she is salaried by the court so usually abides by the rules anyway.

    Look, it's not going to happen. Pay them what you can afford.

    Thanks, made me feel a bit better. So even if i can only pay them £10 tomorrow just do it?

    can i even get an over draft with a bad credit rating?

    Do not think about an overdraft given the circumstances in which you find yourself.

    Fill THIS form in and send it to CapOne with a letter stating what you can afford every month. Say also in the letter then you wish all phone calls to stop and all communication to be by letter from now one. If you can, send your first payment too.

    REMEMBER - your rent, gas, electricity, council tax and water take priority

    I'm a former bailiff and I want to add my opinion to those you already have saying bailiffs won't call.

    In order for bailiffs to call you need to have been taken to court for the debt and had a CCJ granted against you. The court then needs to be asked to enforce the debt by bailiff action. All of this you would be told about and have an opportunity to deal with.

    Debt collectors may turn up, however (though I don't think this is likely), but they have precisely zero powers to do anything except stand on your doorstep (lets hope it rains) and mither on at you that you need to pay because if you don't then they'll have to ask you to pay. At this point you can tell them you no longer want them there and will report their trespass to the police if they don't go away.

    You do need to deal with this issue, you already know that of course, but you can be in control of that process, not them.

    i dont know how true this is (hopefully someone can clarify it) but i have heard bailiffs are like vampires.....

    if you let them come into your home once, then they can come back at anytime without seeking you permission. for this reason they will try tactics such as asking to use the loo or asking to use your phone to try and gain that initial entry into your home.

    For everthing else there's mastercard.
    For clampers there's Barclaycard.

    Baliffs have nothing to do with this OP in question.....
    For everthing else there's mastercard.

    As some of the others have said dont worry about the baillifs.......credit card companies will threaten everything under the sun to get people to do what they cant afford to!! So a few suggestions from me, having had a lot of experience of this lot:
    Don't speak to them on the phone - ever!

    Put everything in writing and require them to respond in writing (templates for letters are available on the debt forum and from one of the posters here

    Useful to send it recorded delivery although they dont always sign for them

    Don't sign your letters - just print your name

    Offer to pay what you can afford (even a pound) and just pay it even if they hassle you for more (which they will)

    You could try requesting a credit card agreement although you have been paying so have therefore acknowledged the debt

    If they harrass you then use one of the template letters reminding them that they have to adhere to law regarding this
