Esa medical report

Had my ESA med and got put in the work focus group,during the medical i showed the examiner a letter from a consultant that said i have tried all treatments without success and the only thing left to do is manage pain levels and that it will be downhill all the way,expect further deterioration.
So i was surprised to read my ESA report said with the right treatment could be expected to be back at work within 12 months.THERE ISN'T ANY MORE TREATMENT!I GIVE UP!

    appeal, appeal, appeal, complain that the person blatantly lied if you can prove, ie that letter you showed them

    You can appeal against this and try to get put in the Support group but whilst appealing you will only be paid at the assessment rate of ESA.

    When you appeal, send photocopies (never originals) of any medical evidence such as your consultants letter with your appeal, to show the descision was wrong. however Atos Medical are tasked with finding everybody who may be able to do something fit for *some* form of work for our own good. By that logic a wheelchair user would possibly be ok in a call centre, and other stereotypical assumptions. You should also try CAB and Welfare rights, if possible to help you appeal.

    Covertly tape record your next medical.
    Hide the recorder somewhere it wont be seen (not somewhere you may have to remove the clothing from), dont tell them you are recording under any circumstances.

    As for them lying, does not suprise me it all, seems to be fairly standard operating procedure, never had a assessment yet where they have not either lied, twisted things, or missed out evidence etc.

    I appealed to be put in the support group and was paid at the rate of the work related group. As the OP has already been placed in this group surely he will get paid at that rate?

    I have read elsewhere that someone who appealed was paid at the assessment rate when they appealed the group they were put in, it looks like we need stazi to help on this!

    Yes that is right the forum is full of trolls who answer peoples questions and try to be helpful, I expect more will be along soon!
