yet another vodafone problem

well its been a month or so since getting a replacement nokia 5800 for the faulty but allegedly fixed by them 3 times and suprise suprise this one has done exactly the same thing. so after another trip into their crewe branch its on its way back for repair. the store says theres nothing they can do but send it away but i think i have now given them enough chances to supply me with a product that works. i'm tempted to just cancel the direct debit, and let them do their worse. but what do you guys and girls think. i'm sure that the sale of goods act should apply here and that i'm entitled to cancel my contract as they can't supply what i want. i really don't want to make endless phone calls and it would appear that emailing them makes no difference

    The phone and service contract are separate, do not cancel the direct debit.
    It can screw up your credit file for 6 years and be a very costly decision to make, and with debt collectors they will get the money from the contract, so i repeat don't decide not to pay!

    Under sales of goods act they must provide repairs, replacement or refund if the item is not it for purpose. If they are unable to repair the phone then a replacement or refund must be offered. You may well be able to claim compensation for the time you are unable to use the service contract, as the retailer is responsible not the manufacture for the device.

    My advice would be to ask for a replacement, and state the number of days you have been without a phone and would request compensation for those days. i.e. 3 repairs at 10 days each is about 1 month, so claim against them 1 months price of contract.
    Although no trees were harmed during the creation of this post, a large number of electrons were greatly inconvenienced.

    as said dont cancel the direct debit, i had the same problem with my SE 890i it was on the sixth time that i was about to send it back that i found out about the eforums on vodafones web site. Go on there they are far more help that any of vodafones store or call centre based staff as within a week of posting there my w890i was replace with a nice new N96, which came with its own inherant problems due to VF's fireware that they like to think enhances the phone but thats a different story. Get on the eforums and it should be sorted pretty quick. All this in mind i am happy with VF but when its time for a new phone i will be sourcing my own unbranded handset
  • thanks for the replies guys. not going to cancel the DD. i was hoping that the rep would reply but she/he might be busy with what appears lots of problems with vodafone. i tried the eforum last time and they just kept deleting my post because i was talking about cancelling my contract. to be honest when i get the phone back i think i'll just put it on ebay and to hell with it. i think at the end of this contract voda and me will be getting divorced. i can't believe how useless the in store staff are.

    I'm sorry to hear of the problems you have experienced with your 5800, I appreciate how frustrating it is being without your handset so often.
