  • Hi

Tesco can do a 'Not as Described' chargeback, but they will need a few things. First of all is your card Visa, Amex or Mastercard? and when did the transaction go trough?

I recently purchased 2 pairs of Uggs online without realising they were fakes they were 'on offer' reduced from $120 to about $70 a pair.

They sent me one pair in the wrong colour and they dont fit my partner.

I have emailed the company to say I want a refund and he wants me to forward them on to someone else, I have refused to do this.

It now looks as if the website has closed down as when I used my saved link it is blank and I cannot get access to my Emails as they were through something called billing support

I used my tesco credit card so i should be covered to get my money back however they seem to not want to help in the slightest and i do not know what to do next

any help is greatly appreciated as my partner still has no birthday Uggs

I need help as I don't know what to do next

You're not the only one, you should get some useful info from here.

I've also read that ugg boots are a style of sheepskin boot and unless they said specifically on the website that they were genuine, you may have trouble getting your money back from the credit card company as they have actually delivered them to you and you have received them. If they hadn't been delivered that would be a different matter.

I spoke to my credit card with a similar thread and they said they, (the supplier - i.e Ugg boots company) had fulfilled their contract to you by supplying the goods you asked for and if there was any discrepancy with the product that is between you and the supplier, the c.c company were not liable in the eyes of the law.

It might be worth trying with the credit card company again but I wouldn't hold your breath.

Good luck, hope you get your money back.

  • have had an update recently from mastercard covering things like counterfeit Uggs and GHD's, if you receipt/order confirmation stated Ugg (gen or not) an you can get an independant report (letter on headed paper from a retailer) and then write a letter to your cc company stating what has happened and you have suffered a finacial loss, they can process a claim.

With Visa/Amex its very similar but the goods also have to be returned or attempt of return (recorded delivery or courier receipt) again the CB regs are set by the regulators not the card providers they just have to follow them.

    :)
  • Probably not much help to the OP but it would be good if there were a civil court case to resolve this issue.

For a legal perspective I disagree with Mastercards view. If the website was UK registered and it held out that the boots were "UGG" i.e. a recognised brand similar to "Levi Jeans" or "Cartier Watch", then in the vent that the goods turn out to be fake, they were not as described and the purchasor would have a claim against the credit card company as well as the supplier. Mastercard's position that you have to have a receipt that mentions "UGG" is open to challenge as obviously you would not get to the "receipt stage" until you had pressed the order button and submitted your card details.
