    I hope so ,but in my case i gave them an extra 4 week and still got negative answer Sunny

  • Well D-Day has arrived-14 Jan 2010, this is the date I was assured that FP would have sorted out my case after telling me they required a further 7 weeks after the 8 weeks I had already given them. Surprise surprise, postman comes slidding down driveway with nothing from FP. :mad:
    Complaint has been lodged with FOS in November '09.......what should I do now? Other site users have been given recorded transcripts and CD's of conversations-we have had nothing except fob off letters.

    Any advice please??????

    Hi, you would only receive the transcripts and CD's etc if you have requested a SAR (Subject Access Request) from them. If you want this you have to pay them £10 and it can take up to 40 days to arrive. There is a template here.;)

    If you do go this way then send the letter by recorded delivery so you have dates and proofs.

    Hi there Dave

    Give them another call, I know its a right pain but tell them you have not received anything in the post up to know and was told that you should hear by today the latest.
    There may be a delay also due to the weather conditions, as some post are behind due to this as well.

    I would also request they send you the details of any recordings and transcripts.

    Did you actually send them a Subject Access Request (SAR) with the £10 cheque or postal order payment for your details?
    Just making sure, but if not maybe its worth you doing so, link here to SAR template:

    They have 40 days to comply and post by recorded delivery.

    If you have already lodged in a complaint about FP with the FOS, this may be a reason for not hearing as well, maybe the FOS have been in touch with FP to send them details, but let FP clarify their reasons to you on this.

  • Just phoned FP and asked why I still havent received a reply as their given date has passed. Spoke to a lady there and she informed me they were having trouble accessing recorded tapes of conversations because it is an old loan. She said even when they do locate them they could be "distorted" due to the age and would be of no relevance anyway. They may locate them today, tomorrow, next week, next month etc.etc.
    Do I leave it in the hands of the FOS or is there anything else I can do in the mean time. I havent as yet requested a SAR and pointed this out to her, all I would get back at present if I did would be paperwork which I already have. She offered for me to contact the FOS so looks like she doesnt know I already have contacted them in respect of the claim.

    Any suggestions????

    What year did you take out this loan with FP?

    You could contact the Information Commissioners Office (ICO) for advice if you want to and see what they suggest in regards of the recordings.

    As you already have it in the hands of the FOS that is fine.

  • Hi all,

    Just had it confirmed by FP that a cheque was issued yesterday for more than we expected!!!!!!! - WE WON!!!!!!!!

    Had a letter a few weeks back out of the blue from FP saying they wanted to settle as a goodwill gesture but did'nt post as did'nt want to count my chickens etc. etc. (Still holding my breath until postie comes tomorrow)

    Still cant believe it and would like to thank especially Di & Marshallka for their advice and support over the past months. Looking back now the time scale to resolve this has flown by but at the time it did drag. I would strongly urge anyone who is thinking of claiming to do so......I was in two minds last year but my better half pushed me into doing it and the rest is successful history.
