Phones4U cancelling contract HELP!

14 days ago today, I took out a new Vodafone contract with Phones4U. I am very very unhappy with the phone, basically it's a piece of crap! And the contract I was sold, I was told it was £40 a month but I have been charged £45!
When I took out the contract, the lady who sorted it all out to me actually told me I have a 14 day 'cooling off' period, and if I am unhappy with the phone I can bring it back within that time.
So I went in store yesterday to try and return my phone but the manager told me they no longer operate this 14 day cooling off period and pointed out that it says it in my contract! I went to another store too and was told the same !! Apparently they stopped doing it in August.
I really need some help, is there any way I can get round it. Today is the last day of this so called 14 day period and I'm really upset with this!
Please if anyone has any advice???
Thanks.

You would have to speak to consumer direct about possible misselling of the contract.
The problem is that if it was detailed in the contract it was £45 a month and no returns allowed, you read and signed this in store you ma have a difficult case.
As you sure it wasn't £40 a month due to a redemption offer?Although no trees were harmed during the creation of this post, a large number of electrons were greatly inconvenienced.
There are two ways of constructing a software design: One way is to make it so simple that there are obviously no deficiencies, and the other way is to make it so complicated that there are no obvious deficiencies0 -
I was under the impression that any credit agreement had a 14 day cooling off period? Is this not the case?Slimming World member - started 13 January 2010Starting weight: 11st 4.5lbs :eek:/ Current weight 11stMini Goal 1: 10st 11.5lbs (1/2 stone)10% Goal: 10st 2.5lbsMini Goal 2: 9st 9.5lbsGoal weight: 9st / 2.5lbs to MG1!0

A phone contract isn't a credit agreement, it's a service contract and the same rules don't apply.0

You remember almost right.
Seven working days for goods starting when the goods are delivered, and for service contracts, seven working days from when the contract was formed (which would usually be by signing for the handset when it is delivered).0 -
And this was bought in store (as I read the op's post), so there's no cooling period any way.0

No offence but why did you sign a contract if you didn't like the phone? The lady you spoke to will have demonstrated the phone to you.
If you look at the bottom of the "are u happy" sheet you signed (both copies!) it does state in bold writing that Phones4u do not operate a 14 day cooling off period.
What phone did you get? If there is something that doesn't work right, I might be able to help you via this forum or alternatively go back in store and they should be happy to show you full use of the phones features etc.
If the lady didn't demo the phone and did in fact tell you that there was a cooling off period then I would suggest ringing customer services and seeing what they can do.
No other stores do 14 day cooling off periods which is why P4U changed so they were in line with the rest of the companies which makes sense in my head!
Hope that you get to love the phone, some of them do take a bit of getting used to!
Hope my advice helps and you don't take it in the wrong way.0
