Variation and Working/child tax credits

Did I read in some leaflet somewhere, that if you recieve WTC and/or CTC then a variation request by the RP would not be considered?
And if that it so does it apply to a variation of "undeclared income not taken into account"?
I am looking to write to the CSA as they are asking me to provide my "tax calculation" forms (no problem there though) but a nice timely intervention reminding them of their own rules would be good to head them off at the pass.

Relativity - the study of relativity will reveal that time passes through all points simultaneously prooving that space and time are entirely reletive depending on who is asking the question and what answer you want to give.

tax credits are classed as nrp's income.
they've only got to do a quick check with the IR and they'll have the figures anyway.NEVER ARGUE WITH AN IDIOT. THEY'LL DRAG YOU DOWN TO THEIR LEVEL AND BEAT YOU WITH EXPERIENCE.

Yup got that and so they have got the info, but the question is; I think that I read somewhere (in a tax credits booklet) that a variation would not be considered if the NRP was claiming WTC/CTC
Maybe Ive read it wrong but I cant seem to find it now
Any ideas?Relativity - the study of relativity will reveal that time passes through all points simultaneously prooving that space and time are entirely reletive depending on who is asking the question and what answer you want to give.

Got it its in the booklet titled "How is child maintenance worked out"
Booklet number CSL303
An extract
Page 31
What happens when we are asked to take other
factors into account? When one parent asks us to take other factors into account,
we ask them to tell us why they think the amount of child
maintenance should change.
We usually send these details to the other parent. This enables
them to tell us what they think and to get information from
everyone involved. We can then make a decision about whether
to change the amount of child maintenance. What happens to my child maintenance?Your request can increase or reduce the amount of child
maintenance that must be paid or may not change it at all. When can’t the CSA change child maintenance? We don’t usually change child maintenance if the non-resident• we have made a default maintenance decision (see page 26).
parent asks us to and:
• they or their partner is getting income-related benefits or
Pension Credit
• they or their partner has been assessed as paying flat-rate or
nil-rate child maintenance, or
Page 32
Also, we don’t usually change child maintenance if the parentaccount these overnight stays.
with care asks us to and:
• the non-resident parent or their partner is getting incomerelated
benefits or Pension Credit
• the non-resident parent or their partner is getting Working
Tax Credit
• the non-resident parent has an income of more than £2,000
a week, or
• we have made a default maintenance decision (see page 26).
Finally, we don’t change child maintenance if the non-resident
parent has expenses for periods when the child stays overnight
with them but we have already reduced the amount to take into
Now under what rule can they buck these comments?
Im sure they have a catch all but........

They will probably get around it with the use of the word "usually".August GC 10th - 10th : £200 / £70.61

So once again what are the RULES?
Have they got any? do they make them up to suit each claim on gut feel?
Do they change? where is the rule book they use?
How can they advise "usually" under what rules can they make exceptions? where are they written down?
Do they know what the flook they are doing? Does anyone?
Just interested, it might be worth just asking, just so we know, just in case, you know.........Relativity - the study of relativity will reveal that time passes through all points simultaneously prooving that space and time are entirely reletive depending on who is asking the question and what answer you want to give.

I'm not saying they WILL use that to get out of it ... I was saying if they did try to, they could possibly use that word.
It would be useful to ask and find out their reply.August GC 10th - 10th : £200 / £70.61

I have just asked and they are very evasive about it.
They waffle on about primary legislation, very difficult to give you an exact answer, got case legisalation, all very fluid all very cant give me a written explanation, cant fully explain, basically just send us your gross income and we will decide for ourselves what you should be paying.....
They dont want to tell me they just want me to declare my gross then watch out.................
So I asked them how do you want it presented, they said send in my TAX CALCULATION.
I said what form number is that, they said "dont know" how pathetic, they said fill out one of our forms instead CSA140.
I said but you have just stated that you want a tax calculation form, they said oh if you cant send us that then you need to make a separate decleration on one of our forms.
Oh no you dont you need the TC form "what number form is it?" reply "dont know"!!!!! (I tell them I have a form saying TC its form no SA302 is that the form you want? "dont know"
Says I can you please find out and let me know and when you do I will get it and send it to you, if I havn't got it I will ask the IR to send it to me and I will send it to you is that ok?
Erm I will have to get back to yoou then............

Thing is speedster they DO have HMRC accountants working for them (on secondment apparently but they see m to be there for the duration) so if I would you I would put your request in writing to them and then let them tell you what it is they want! Otherwise you could send them anything
which is what my ex did. They asked for his accounts - he wrote them out a single sheet income, expenses, net profit, amazingly the income and expenses almost cancelled each other out and they accepted it - no questions :eek: Free/impartial debt advice: Consumer Credit Counselling Service (CCCS) | National Debtline | Find your local CAB0 -
