Mobile Phone Contract
                    Hi.
Can anyone tell me if there is any possible way of getting out of a 2 year contract with 02? I have had my phone for over 2 months but returned it just after the 28 days because it didn't work. I told the company I'd bought it from that I only noticed the problems whilst I was on holiday and returned it immediately upon my return to the country, but as I was two days out of the 28 day period they wouldn't listen. After an argument with them, they said they would send me a new phone, rather than waiting for the old one to be fixed. Prior to speaking with this company, I contacted 02 about my contract and they said it was up to the company I'd bought the phone from, so I asked them if they would withdraw my contract but they said they couldn't do that. I was wondering about buying myself out of the contract but fear it will be costly.

Buying yourself out of contract will be 22 months multiplied by your monthly line rental, so yes, it will be costly.
You had a faulty phone, it has been replaced, so therefore there is no problem correct?0 -
Sorry I was too quick to send my message before I had fully explained the position. I purchased an N97 which is problematic, hence returning it to the company. I initialled called them to let them know it wasn't working and they said "no problem, we'll refund you". I was happy with this as I have read numerous reports about the N97. Two weeks later, I had not received a refund and not heard from the company so I called them, was promised a call back but no call back. I called again, was told that the phone had gone to repair centre, told them they'd offered me a refund but they said I'd been incorrectly informed. They had no idea when the phone would be fixed, where it had gone to be fixed so I asked if they would cancel my contract as I didnt want to be paying for a contract when I had no phone but they still said no. The guy on the other end of the phone knew he wasn't going to get rid of me so he said he would send me another phone but I don't want it as its the same as the one I have returned and Nokia themselves are still trying to rectify the problems, although the guy at the company says this is untrue as they would have recalled all the phones. I don't think so! Anyway, that's the shortened version!!;)0

I still don't see what the problem is to be honest. I can see it is annoying and you have possibly been misled, but you have a faulty phone and it is being replaced/fixed.
How much did you pay for the handset? That is all that would be refunded, they didn't mean they would cancel the contract!0
