MSE News: Bank charges: banks win test case appeal
Comments

The banks have succeded in dividing us as a community in order to turn the rest of the population onto the claimants.
The exact same thing is happening in a current court case I am closely following about incorrect Toxic Waste disposal and deformities in children. The Council stated they have a duty to the council tax payers to fight the case to stop any compensation being paid.
Of course they succeeded in dividing the community and now the claimants look like the evil party. The residents don't care about the children and their deformities as long as they make sure they don't have a rise in council tax to cover any payable compensation.
A great point MillaJoJo. I completely agree.0 -
I can't believe the number of comments like this one that imply that those who are prudent with money, taking care to budget are somehow to blame, while those who borrow money from their banks without prior approval or consent are somwhow the victims in all.
I cant belive the amount of narrow minded posts that assume that everyone that gets a bank charge is just not taking enough care and deserves everything thats coming to them.
Is it to hard for you people to understand that peole struggle with everyday things, and try hard only to be charged thus making the job even harder in the future.
oh and how do we borrow the money without consent??? the last time i checked the bank didnt pay my direct debit then charge me 40 quid for the privalige. all they did was refuse the payment and send me a letter. Not really the same as lending me money without aproval!!!:mad:0 -
I am absolutely numb, back handers galore, the fat cats dont care bout us, we are just minions to them, they dont live in the real world where people are losing their homes, their jobs, etc. I was hoping to have the bank charges back through financial hardship, stupid me for presuming we were gonna win for once, MERRY XMAS 'fatcats', hope u can sleep well at nights0

I agree that people should manage their account better, and in the pst that includes me but you can see a mile off whats happened.
Banks in the past have far too easitly preyed on the vunerable and gave them silly amounts of credit, which now in the time of recession are finding it hard to pay back.
Banks have continually been bailed out and still their fat cat bosses enjoy their all expenses trips for champagne frollicks. By all means charge us but make it fair and look into individual cases, instead of us trying to talk to brick wall of crap customer service advisors who contradict what their colleague said yesterday and possibly get them to speak english (no disrepect intended). Banks are pretty much complusory and should be looking after their customers, not taking advantage of them.
Allowing the banks to lose this would open the floodgates to charging on ATM, charges to have an account etc etc and we would still be forced out of pocket.
We all but know the government have probably had a hand in this to save their banks but what now?... Have we saved our free banking.. Well im now paying £12.50 a month for a current account. Do you think the banks will now scrap it and allow free banking, i think not.
Until the whole banking system is over hauled completely including credit cards etc etc we will still all end up being ripped off which ever way they Supreme court voted.
This country is one big rip off and thats why its gone down hill fast!
Bye Bye Gordon Brown!0 -
Talk about cutting your nose off to spite your face!
So, if you were not happy with your Electricity bill and your little campaign managed to get 2/3 of the UK to turn off every electrical appliance in their homes - do you think that would make the slightest difference? No, the electricity company will still be there come Monday morning, lets see how long you can go without a bank account.
Have you ever had cause to complain about treatment you've received that you feel is unfair or out of order? Or do you just accept what you're told and happily jump through hoops when you're told to? If so, you're just the sort of person this country/government needs. People who don't think to question decisions or mind when you're not given a choice. You'll go far.0 -
Its those who go overdrawn who already subsidise you... muppet!
Does anyone know where the bank bail out money has largely gone to??? It is repaying "toxic assets" or bad debts. These are debts where the taxpayers have individually borrowed but can't afford to repay (usually the people that pay bank charges and might appear on this site) Can everyone stop whinging please...0 -
This was completely unexpected, I must say, but I just wonder how this affects us Scots who have a completely separate legal system.
Theoretically Supreme Court judgements do not apply up here, so it would be interesting to find out whether or not the Scottish Courts can just ignore this terrible decision! Ant Scottish advocates out there who know the answer?0 -

Anyway, I've got a case already won in Northampton but with payment stayed pending the outcome of this ruling. Any ideas on the way forwards on that one? Yes, I've got a horrible feeling too!
Me too, won my case because Barclays failed to put a defence in on time. This was 2 days before the stay was announced. Can they really overtern that decision? Anyone giving odds on this...
Wonder if the bankers bonuses will go up from this?0 -

Exactly, we don't get 'free banking'; those of us who are fortunate enough to be in credit or have savings are paying for our own banking with the profits the banks make on our money.
Those who are overdrawn do not make any money for the bank so pay for their banking with fees.0 -
Just been reading in another forum, which says that the supreme court have said that people can still persue the cause by using clause 5 of the utccr because it invalidates clause 8.0
