DLA claim turned down because of dwp doctor

My wife recently applied for a review of her DLA she was on the low rate of DLA but because her health has become a lot worse she tried for a higher or medium rate DLA.

The DLA higher rate was turned down, the Welfare Rights who are now handling the challenge have found out the reason for the refusal was a report from the dwp doctor from his examination of Jan this year. The information which he put on his assessment was completely wrong and even no mention of her illness which is the cause of her health deterioration. Her medical condition can be verified with her GP and hospital consultant.

My wife is very upset with the dwp doctor’s report which is completely inaccurate and false. Therefore I suspect that the next stage of the DLA claim will be the appeal, but with the dwp doctor’s report I presume that it will be turned down again.

Is there an appeal process for the dwp doctor’s decision?

    You can appeal about the doctor's report. These doctors are paid to get people off benefit, and seem to be the ones who couldn't get a job actually practising proper medicine in the health service or private practice. Many seem to have questionable overseas qualifications.

    Some time ago someone on here linked to a job advert for these clowns. They should be fought all the way, and if necessary reported to the British Medical Council. They are very much the dog-end of the medical profession. If I remember correctly the DWP/Medical Services were even willing to take on people who were not doctors, just healthcare professionals.

    Please dont loose heart. I know easier said than done, but if your wife is not well and she qualifies for the middle/high rate DLA then you should fight tooth and nail for it!

    I receive high rate and low mobility and over the next couple of months will be asking for a review as I have recently had a stairlift fitted and use a wheelchair whilst out. I am not looking forward to this and sometimes feel its easier not to rock the boat, but I know im entitled to it and have my OT and GP's backing.

    I have heard too that these DLA doctors that come out actually get paid off for writing untrue accounts-how accurate this is, I dont know-but sounds very possible.

    It truly is terrible and just wanted you to know that Im thinking of you ATM. Did they turn the claim down completely, or has she still been awarded the low rate?

    If its confirmed by doctors & hospital consultants, you should def. appeal. The same happened to my mum & we did'nt even have to go to the appeal to get the decision we wanted. If all else fails, take it up with your local MP. Goodluck, hope this helps :)

    A very good friend of mine has been going through this recently. He has been claiming DLA for a number of years and asked for it to be reassessed as his condition had been deteriorating. The DWP 'doctor' came out to do his medical on him. 2 weeks later he was being told he wasnt entitled to it and shouldnt have been recieving it for so long in the first place. His wife is also serioulsy ill and with 2 young children to look after they were living off of just CTC and CB. They went and saw someone as there local CAB office who advised them to appeal against the desicion. Which they did they were advised to put that they werent physically able to attend a court hearing. Instead of taking notice they arranged a court hearing miles away from where they lived and yet they were expected to go. That was last friday the case has now been ajourned (sp?) pending further investigation into the DWP and their doctor. Apparently from what was said in court last friday the report was written in pencil and it has clearly been rubbed out and rewritten. They have been advised to get legal representation asap and they are waiting for it to go back to court again.

    Please please dont give up, appeal it, visit your local CAB office contact a solicitor for advice.

    tehy are truly awful, i went for an assesemnet when i was very very ill and he made me cry i was upset for weeks at what he said to me (he mocked my condition basically- i think he was trying to get a rise out of me but i dunno what for?) i just cried and cried so much i couldnt talk so he told me to go and a week later i got a letter saying teh report found i was still ill how would he know he never asked me owt?! surely tehy should ask your gp or hospital consultants, my gp could have gievn a proper report on why i was ill and how it affected me egttign a job at that time.

    i went for my first one today, doctor didnt seem to bad really, no real attempts at anything underhand, standard questions, he got very confused and slightly irate when i wouldnt answer yes or no to some questions, i refused to bend down and touch my toes which didnt please him, my condition is pretty obvious really and backed up by an mri scan report, but time will tell, not really a stressfull experience

    It’s an awful situation regarding of the dwp doctors conduct and practises which they use. I guess they are all on commission and get a bonus if the claim is turned down?

    This doctor must have been the most two faced person I have ever met. He was has nice as pie through out my wife’s examination and he was the one that even recommended we should try for a higher rate of DLA!


    We could not believe the information that we received of his report, we are still under shock! My wife is now giving up any hope of getting a higher rate of DLA, she is fed up to the teeth of all the forms and waiting!

    I guess we are lucky that they did not remove the low rate dla which has happened to a few other I know.
  • Just got to say, my mum had a DWP doctor do a home visit for his assessment (first time applying for DLA). The doctor was great. He could see that my mum was playing down her condition and basically put words into her mouth in order to make certain she would get high rate care and mobility. She's in her early 60s, yet cannot walk very far and cannot look after herself anymore due to her lungs having packed up and having all sorts of heart and kidney problems. She's also on oxygen for the rest of her life due to the lung problems, as well as being on warfarin for thrombosis. However, when questioned, my mum said she could walk, etc, etc. As stated previously, the Doctor could see that my mum was just to proud to admit that she's having real problems. He was very considerate, sensitive and kind towards her. Oh, and he was a foreign doctor - an African.


    Although there are some bad doctors out there, they are not all bad.

    I'm not clear as to the relevance of this, perhaps you could explain?
