Just watch this company...statute barred or not they will often put a default on your Credit Report...they did this to me but I got the Ombudsman involved and they removed it and acknowledged I didnt actually owe the money ion the first place..... they are real slippery so and sosBOI Credit Card = Was £3500.00 Now £0.00

By the way, if you claim the debt is statute barred they will say you made a payment in 2004.
But can never provide real proof, if pressed.

watch these dogs they have been hounding me for about 2 months now!! i have said the debt is barred under the 6 year rule..:T but then they came back and said that there was a ccj on the money owed,now thats strange because if there was a ccj on the account by the original creditor then why was it sold to aktiv? they will hound you to death im getting about 6 calls a day from them at the minute. stand your ground and dont admit anything dont even confirm your DOB to them, check your credit file its free with experian and if it aint on there anywhere then dont worry it will be statute barred under the six year rule:DIf the last time you paid the debt or acknowledged the debt in writing was over 6 years ago (or 5 in scotland) then the debt is statute barred. Either ignore them or send them a prove it letter and if they can prove it send them the statute barred letter

or even say it has a ccj attached to it now we all know if that was true the company who lodged the ccj would not have sold it to monkeys to pursue!! chancers report them to the FOS i have they didnt like it when i said that to them :rotfl:AK are well known for their scattergun approach - buy a load of dodgy debts at next to nothing. Then pursue anyone and everyone who has a name vaguely resembling the debtor.
This may not even be the op's debt!
Momo would be doing everyone a favour by reporting them but I can understand the 'ignore them and they'll go away' approach too.
By the way, if you claim the debt is statute barred they will say you made a payment in 2004.0 -
Hate to burst your bubble but yes they can and will sell debts with CCJs on them... have you bothered to look up if they have taken out a CCJ against you or are you merely assuming that there isn't one?DFW Nerd #025DFW no more! Officially debt free 2017 - now joining the MFW's!

A couple of years ago we got a similar letter from Aktiv Kapital stating we owed over £5k. We took some advice from a friend (hadn't found DFW then) and sent a letter with a £1 postal order stating we had no knowledge of the debt and advising that they should either provide evidence that the debt related to us or stop contacting us.
Practically by return post (two days later) we got a letter stating this matter was now closed and returning the postal order. We have kept the letter and postal order just in case this ever rears it's head again.

That's a very dangerous practice, particularly with these sharks. You were very lucky they didn't bank the P.O. and claim that you had acknowledged the debt by way of payment.
You need to send £1 if requesting a copy of a credit agreement for a debt you know to be yours, or a tenner for a subject access request.
Otherwise, never send money.0 -

I live and learn (learn more everyday now I've found this site).
We did make it clear in the letter that we did not acknowledge the debt as ours and had no record of ever having had such a debt. We also stated that if they genuinely had reason to believe the debt was ours then they provide us with a copy of the credit agreement (and made it clear that was what the postal order was for).

Hi, not sure if I've got the right thread.
Recieved a letter from 'aktiv kapital' a couple of months ago claiming I owed £330. I stupidly rang them, believing they were refering to my credit card, as soon as I realised it was an old debt (from 2000) I told them I would get back to them, and hung up.
Rang them again and told them I did not aknowledge the debt and left it there.
They've been ringing me everyday since (2-3 times a day). Today I answered a call and told them it is a statute barred debt and to leave me alone, but the man I spoke to kept on at me and I unfortunately got upset and explained that I have bi-polar and have drug and alcohol problems.
When he started asking about my 'case worker' I stupidly mentioned the mental health unit I attend (not the name of my 'case worker'). I couldn't believe it when I could hear him typing it in.
I cannot believe what these people are prepared to do. I only have limited control of my own finances and if they were to contact my social worker, it could have have a greater affect on my financial independence.
Manic at the moment, so I apologise for the rambling. If this makes sense would appreciate a solution.0
