who provide other services take money you have paid them for Gas and Electric and pay it into any other service they provide?

In others words you pay x amount on gas and electric and you have a another service with them which is in dispute they then take the money you have paid them for Gas and Electric and take it off the service in dispute?

Which then makes you in arrears with gas and electric even though you have paid them for gas and electric?

What does the terms of your contract say?

It does not state anywhere where they can take gas and electric payments and use them in any other part of the account and of course there are statutory regulations. So if you have a multiple account of services and you are in dispute pay your gas and electricy then they cannot take this money and and use it to say pay telephones.
That is why they can only place on pre-payment meters gas and electric debt.

Incidentally what they did was close one account at the end of last month. And then open a new account. They then refunded money backdated to April on the old account to April which means the new account started back then even though we have proof it did not by bills and now makes the NEW account look as though it is in arrears back to April.
Old account closes end of Oct new account Opened old account gets credited new account gets debited back to April.
This means they have stolen the money paid for gas and electric on the old account and credited it to a legally disputed account that has telephones on it etc. And billed the new account. Start date end of Oct. Proof by bills.
As they failed to take payment for gas and electric they also issued a warrant which was paid on the old account in September.
This also proves that the old account was still open.
If you are confused so am I but regardless of what they cannot take money from one account and place it on someone elses account.

Sorry but I'm confused because you aren't explaining yourself clearly - can you rewrite the post in bullet pointed chronological order, state what the services are (label service A/ service B if you must), what the names are (use code, e.g. account holder A/ account holder , what money has been transferred and when??

Was the money taken from one account with one name on and applied to an account for the same service with a different named person? Or taken from an account for one service and applied to an account for a difference service but the same name on? Or taken from an account for one service in one name and applied to an account for a different service in a different name?

Does the supplier have reason to believe you are changing the named account holder in order to avoid paying a debt (e.g. changing name from you to your OH)? Or was it their idea to close one account and open another?

They're not. They're putting it on another one of your accounts. Completely standard (and legal) practice in multiple industries and contracts.

If you have a dispute with them, resolve the dispute and meantime don't continue to take services from them.

If you knowingly continue to give your custom to the same company then knowingly continue to hand over money to them - what do you expect?

If you have written evidence that you have registered a dispute on an multiple service account the company is NOT allowed to re-direct money for one service to another. That is a fact, regardless of whatever it says in their contract.

Get in touch with a local CAB office and let them sort it our for you.

I'm not sure where you got all this information from within 90 minutes of posting asking for advice, but it sounds like you now think you know the law.

Why don't you now start legal proceedings if you believe they have acted unlawfully and won't otherwise resolve the dispute?

Right there has only ever been the ONE account for many years. No other account existed. I know they cannot legalytake gas and electric payments for anything else but need to know exactly where it states this or words to that affect. As we have all the phone calls recorded and what they have done including threats, these are on a webiste at the moment, but the energy ombudsman is involved the problem is though what they have done now is a seprate complaint and if we took them to court then the energy ombusdman could not get involved.

johnjames1, if you are going to get anywhere with this, you need to be able to write a more coherent account of what has happened. If you take it to a complaints body outside of the supplier, and you are that incoherent, your complaint will firstly be pushed to the bottom of the pile and secondly, if the supplier then responds with a reasonably written timeline, you will lose almost automatically, because no one will understand you or even want to spend the time trying to work out what your complaint is.

It is all spot on etc. problem is dont want to say too much at the mo but need to know where it states that they cannot use Gas and Electricy Payments for other services etc.
